Wildlife Protection On Legal Research In Our Country

The rise of ecological represents the rise of civilization, ecological decline represents the lonely of the civilization. This requires us to treat life as to ecology. If we destroy the ecological environment which wildlife depend on for survival, also indirectly damage the ecological balance. China is one of the richest countries of Wildlife resources in the world, our country has distinct four seasons, has many places and things, which is suitable for wild animals to survive. But the rare wild animals are reducing year by year in our country,the phenomenon of excessive edible wild animals and indiscriminate killing is serious. The home of wildlife is destroyed by human, the human set up factories and build high-rise buildings in the animal survival, some people cultivated farmland, indiscriminate felling of trees which cause many wild animals are homeless and severely damage the wildlife resources of our country. Along with the deepening of the research on wild animals, people have gradually realized the importance of wildlife protection. The author in this paper analyzes the significance of wildlife on the ecological and environmental. Fully recognizing the protectionof wildlife, the conservation of biodiversity, and the maintenance of the sustainable development of nature is to protect ourselves.The country is trying to establish relevant system and strengthen the protection of wild animals through legislation, but the legislation is a long process, which passes through a lot of practice, and meticulous research, so there are some problems when country formulate relevant laws in practice. For example,the shortage of legislation of the wildlife protection in our country, the range of wild animals protection is too narrow, the lack of laws and regulations which are used to protect the wild animal welfare., for example, the legal punishment standard for edible wild animals and killing is too low, the law enforcement system is not harmonious, the public participation is low and so on. Firstly, the author analyzes the present situation of wild animal protection law system in China, and put forward suggestions on perfecting our country’s wildlife protection laws, namely under the premise of "Law of the People’s Republic of China on the Protection of Wildlife"(hereinafter referred to as "the wild animal protection law"), the "Civil Law", "Criminal Law", “Forest Protection Law” and other laws permeate ideas related to the protection of wild animals, at the same time, strengthen the details of the wildlife conservation law the "criminal law" and "civil law" for. Secondly, the author analyzes the defects of the wildlife in the legal system in our country, and cites the typical case of wildlife protection which is discussed by national recently, it clarifies that the public awareness for protection of wild animals is higher a nd higher. Therefore, we must be gradually out of sloganeering protection, practically design feasible system for wildlife protection in our country. Finally, the author combines "Wild Animal Protection Act(revised draft)" in our country that introduced in December 2015,, and makes recommendations to supple and perfect wildlife protection laws and regulations, and suggests to increase some offences,for example,cruelty to wild animals and clear the punishments for diners, intensify law enforcement, analyze the role of public participation to protect wild animals. And it suggests local governments to establish a wildlife protection laws and regulations with local characteristics, which can better protect the wild animals.Because the relationship between wild animals and our daily life is not very close, a lot of the protection for wild animals is limited to the laws and regulations of the articles, or government, environmentalists’ campaigns. But we will gradually experience the meaning of the wildlife conservation greatly, we can’t always put the protection of wild animals as human virtue, we must stand to a higher level, and regard the protection of wild animals as a strategic project which would prove beneficial for many years, and it needs the efforts of each of us.
