Research On The Social Rights Protection Of Migrant Workers From The Perspective Of Marshall’s Citizenship Theory

Migrant workers are a special group who formed since China’s reform and opening up. They are distributed in various industries in urban construction, which play an important role in China’s economic and social development. Justice is our pursuit, which is the fundamental starting point of this paper. China faces many problems in the transition period, one of the problems is the social rights protection of migrant workers. The problem is rooted in the unreasonable arrangement of the current system, which is the loss of the migrant workers’ citizenship. The absence of migrant workers’ citizenship seriously affects the fairness and justice of the whole society and the maintenance of social rights of migrant workers.Migrant workers from rural areas and work in urban, but also retained the original rural accounts. They have made great contributions to the development of our country’s economy and society, and also have gained the increase of income and the improvement of living standard. In fact, the living standard of the migrant workers is low, the welfare system is not perfect, and the result of the national economic and social development is not fully enjoyed. This reality is the background of this article. This paper taking Shenyang city as an example. Marshall, a famous British sociologist, who’s book 《Citizenship and Social class》 described the classic theoretical framework of citizenship. Marshall’s citizenship based proposed civil social rights, state of social public service system supply is regarded as a citizen’s entitlement. Marshall to respect for civil liberties identity as a prerequisite for outstanding social rights, focusing on civil society, public service supply system construction, at the same time, do not ignore civic duty to emphasize, to ensure the balance of social rights and civil obligations. This article will use the Marshall this trinity analysis frame to analyze the farmer social rights safeguard question existence reason, and puts forward the effective solution. As for Shenyang migrant workers social rights protection problem, if the solution is better, which will greatly promote the process of urbanization, industrialization and modernization of Shenyang, promote the revitalization and development of Shenyang City, Liaoning province and even the economic and social development.This paper takes Shenyang city as an example, through the field survey and interview to obtain the required information, the information will be fully reflected in the core part of the paper. The first part mainly introduces the background, significance, literature review and research methods. The second part is the theoretical basis. This part elaborates the related concepts of social rights protection of migrant workers in Shenyang, and focuses on the introduction of Marshall’s citizenship theory in three aspects. In the third part, the paper will be according to the questionnaire results summarized problems about migrant workers’ social rights protection existing in Shenyang City:the first is Shenyang city migrant workers social security rights differentiation; the second is the lack of migrant workers’ social rights protection system in Shenyang City; the third is the rights of social security projects lack of participation enthusiasm.The fourth part and the fifth part are the key parts of this paper. In the fourth part, according to the theory of Marshall’s citizenship status, the reasons of the problems are put forward. This article analyzes the reasons of the lack of citizenship, the lack of social public service guarantee system and the lack of migrant workers’ voluntary consciousness. The fifth part is the countermeasure part. According to the fourth part, this part will put the specific solutions to the problem, these measures are targeted and scientific, in Shenyang City, the social rights of migrant workers to solve the problem of opening up the idea. Solutions to the problems reflected in three aspects:the active protection of the free status, the improvement of the social public service system and the enhancement of the consciousness of the citizen’s obligation.
