Study On The Governance Of Land Law Violations Of Grass-root Administrative Divisions In China

Land is the foundation of human survival and development. Along with the rapid economic development of China, the asset value of land resource is becoming increasingly prominent. While as the same time, the contradiction of economic development and rational use of land resource is more and more obvious. Driven by economic interests, land law violations are emerging in an endless stream. Grass-root administrative divisions, as the first line of cultivated land protection, provide first protection of 18 million mu red line. But in the process of urbanization and the contradiction of "development" and "red line", a large number of land law violations have sprung up which led to the continuous loss of cultivated land resource and the high rates of land petition, producing a serious negative effect on the economy, society and environment. So, Study on the governance of land law violations in grass-root administrative divisions has very important significance.Land law violations happened when the land economic development reached a certain stage. The governance of land law violations is a comprehensive research topic as it involves multiple interest subjects. However, at the end of the power structure, and mostly influenced by China’s system and institution, grass-root governments have most limited administrative power. In recent years, grass-root governance subjects have taken some management measures, but the effect is not obvious, as grass-root land law violations are still outstanding. In the face of the serious situation and the problems existing in the governance process, we must analyze the reasons from multi-angle and deep-level, strengthen governance power and tackle problems with targeted comprehensive use of legal, administrative, economic, educational measures etc. with the aim of effective control of land law violations and reasonable configuration of land resource.This paper starts with the present situation of grass-root land law violations, analyzes the governance activities against land law violations, brings forward the problems existing in the governance process, finds reasons at two levels of internal systems and external factors, strives to explore effective countermeasures with multi-pronged approach to curb land law violations and protection of rural precious arable land resources. Finally the goal of rational allocation of grass-root land resources and regular order of land management will be realized.The first part introduces the research background, significance, research status and research content and methods. The second part introduces the core concepts and related theories. The third part describes the status of grass-root land law violations from data analysis, forms, characteristics, and consequences, taking an example of Qi dong city, jiangsu province. The fourth part analyzes the current governance situation from the governance subjects, means, characteristics and problems. The fifth part explores reasons at two levels of internal systems and external factors based on the analysis above. The sixth part learns from the advanced management experience at home and abroad, and finally puts forward targeted countermeasures from multiple angles such as reforming institution, improving laws and regulations, changing the management system, Enhancing efficiency of land law enforcement and supervision, reforming the government performance evaluation system etc.
