The Research On Legal Issues Of Our Country's Eco-agriculture

With the development and application of sustainable development theory in the agricultural sector, an eco-agriculture differ from modern agriculture produces and rises gradually, which is a new model of agricultural production that blending agricultural production, rural economic development and efficient use of resources with the protection of ecological environment ,that ecological rationality and benign cycle.The development of ecological agriculture not only comply with our national policy of environmental protection, but also conducive to sustainable development of agriculture. At present the development of ecological agriculture in China has made some achievements, but there are also many issues which restrict the development of ecological agriculture, in which a very important issue is legal guarantee of ecological agriculture is uncertain. Therefore,it supports China's eco-agriculture steady and wholesome development to construct a scientific and rational legal guarantee system .Through the analysis our current laws and regulations on eco-agricultural development, this essay points out that the deficiencies of the current laws and regulations on China's protection of ecological agriculture. After comparing relevant legislation in developed countries, this essay presents some measures on legal safeguard of eco-agricultural development. First of all, from legislative point: this paper presents to construct an eco-agricultural Basic Law, to work out uniform requirement of eco-agriculture development goals and the corresponding standards and norms; to complete set legislation of the eco-agriculture, and amend the laws and regulations in time in light of sustainable development; according to local available resources, environment and productivity levels, we should full take the advantages of local and regional resources to design and arrange rationally new systems, to strengthen local legislation of the eco-agriculture. Secondly, this paper presents to establish an economic incentive mechanism to form a blending adjustment mechanism of China's ecological agriculture from the fiscal allowance, taxation regulation and compensation for ecological benefits. Afterwards , it presents to complete eco-agricultural constructive monitoring mechanism , to advocate the dual regulatory system of the government and social organizations for monitoring of ecological agriculture. In conclusion, the paper presents to strengthen publicity and education of legal institutions on ecological agriculture.
