Research On The Counseling Mechanism In Petitions

The petition system is generally known to provide channels for gathering information, to push forward democratic supervision and served as a remedy system for the rights. However, people nowadays lay too much emphasis on the remedy system for the rights, which obvious weakens its other functions. Actually, as China has made significant breakthroughs in its plan for deepening reforms, the social structure and interests are continuously undergoing arrangements and redistribution, which contribute to a rising tide of new problems and conflicts in the form of petitions. Recent years have seen the frequent occurrence of "grassroot petitions", imposing great impact on the effort to construct a harmonious society and even causing disturbance to the national security and people’s common interests. Based on personal experience and the analysis above, the author takes Lianjiang County as an example and attempts to in depth conduct a field research, to explore and summarize the existing problems of petitions in Lianjiang County, to analyze the causes of the petitions under the concept of harmonious society and thereby to propose recommendations for the current petition system.This paper is divided into five parts:The first part is introduction. It includes the background and significance of the research, the domestic and foreign research review, the policies and requirements as well as countermeasures of petitions taken by the Chinese Government at different times, the main views of the experts and scholars on the work of the petition, the relevant petition systems abroad. The author strives to improve and better the petition system through the analysis and comparison of the two views both at home and abroad.The second part mainly elaborates the related concepts and theoretical basis. In this part, the author explains the concept of the work of the petition, which includes the theory of harmonious society and social conflict, reviews the relevant laws and regulations, and describes the procedures of the petition work, such as the recheck mechanism and the route map of the petition.The third part is about the current situation and problems of petitions in Lianjiang County. Based on the data gathered in the work before and files collected from relevant departments later, the author summarizes the main aspects and the related conflicts of the petition to depict the current situation and problems of petitions in Lianjiang County.The fourth part analyzes the main reasons of the phenomenon of petitions. This part starts from the current situation of petitions to find the cause of the complaint letters and visits, analyze the phenomenon and the reasons for the existing problems.The fifth part is to present the countermeasures and suggestion to tackle the problem of petitions at the local government level. This part puts forward countermeasures and suggestions from the aspects of the ideas of the petition work, the fundamental democratic construction, the selection of the leader group, the work system and mechanism.
