Research On The Performance Evaluation Of Chinese Procurators

The evaluation system of procurators is an important means to fulfill the duties of the prosecutor and to improve the efficiency of the procuratorial work. The evaluation system of procurators is to assess the process of law enforcement and the quality of law enforcement. The reasons of assessing the process and the quality of law enforcement of the procurators are as follows:first, procuratorial power has the characteristics of administrative power,the administrative power being subject to the supervision and evaluation is recognized by the modern idea of rule of law concept; Since ancient times,there are administrative officials and the performance evaluation mechanism in china; secondly, procuratorial power is the quasi judicial power, the nature of judicial power determines the prosecutors in performing inspection duties shall be evaluation and supervision.In addition to the introduction and conclusion, this paper is divided into four chapters: The first chapter is the introduction. It mainly discusses the connotation and extension of the evaluation mechanism of procurators, the historical evolution of the evaluation of the law enforcement of the procuratorate is sorted out, and this paper expounds the importance of the evaluation system of procurators to the objective and impartial performance of procuratorial duties.The second chapter is the basic content of the evaluation system of prosecutors. This chapter mainly introduces the evaluation index of the evaluation system of procurators,including the evaluation indicators of the anti-corruption and anti-bribery department,the evaluation indicators of the investigation and supervision department,the evaluation indicators of the department of public prosecution. This chapter describes in detail the evaluation indicators of law enforcement in the case of law enforcement investigators, scoring rules, evaluation of the rationality of the problem.The third chapter is the analysis of the evaluation system of procurators. Although the present procuratorate law enforcement evaluation mechanism has its evaluation necessity, but the evaluation index is too detailed and complicated.
