Study On The Present Situation And Countermeasures Of The Rule Of Law In H City Of Zhejiang Province

Local rule of law construction is the basic link to realize the rule of law in the country. It can speed up the process of the rule of law in local governance and promote the formation of the order of national governance, which is of great significance. Take the deployment and requirements of the plenary session of the Central Committee as a guide, Based on China’s national conditions and local reality, Systematic study of the theory and methods of local rule of law, to promote the rule of law and modernization of local governance to provide some feasible, can be used for reference, It is a great need to seriously study and explore issues. This paper takes H city of Zhejiang Province as a case, cut in from two aspects which include the "H city’s rule of law" mode and the rule of law working system of H city, this paper introduces the present situation, main achievements and experiences of the rule of law in H city, analyzes the existing problems and causes and propose the countermeasure and the suggestion. And from two aspects which include the comprehensive deepening of the party’s leadership of the five major lines of the "H city’s rule of law" mode, and improving the Party leadership and co-ordination of the legal system and mechanism of the of the rule of law in H City, it proposes countermeasures to accelerate the promotion of the rule of law in H city. It has a certain significance to accelerate the promotion of the rule of law in H city. This article mainly uses the literature research method, the empirical analysis method, the case study method and so on.This paper is divided into five parts.The first part (the first chapter) is the introduction. It briefly introduce the proposed question, the research significance, the domestic and foreign research status, the basic concept definition, the research methods, the case introduction and other aspects.The second part (the second chapter) is the current situation and major experience of the rule of law in H City. First of all, it introduces the progress of the rule of law in H city which contains 5 parts.1) Strengthen the administration according to law, which is the fundamental guarantee for the "H city’s rule of law".2) Speeding up the construction of rule of law government, grasp the key link in the "H city’s rule of law".3) Maintain judicial justice, focus on the core of the "H city’s rule of law".4) Accelerated development of the grassroots level democracy, lay a solid foundation for the "H city’s rule of law".5) Actively carrying forward the Spirit of rule of law, create a good atmosphere of the "H city’s rule of law". Second of all, it introduces the status of the system and mechanism of promoting the rule of law in H city which contains 9 parts.1) Establish the party’s law office organization and leadership system.2) Strengthen the deployment of propulsion system.3) Improve the working mechanism.4) Improve the examination and supervision mechanism.5) Carry out the rule of law to create evaluation work.6) Create a rule of law construction of key projects.7) Establish to promote the reform of the mechanism.8) Explore the mechanism of record review.9) Innovate carrier of legal construction. Thirdly, it arranges the main achievements of the rule of law in H city in 10 years.1) Explore a way to construct the rule of law with the idea of socialist rule of law as a guide.2) Explore a way of building the rule of law to adapt to the forefront of economic and social development.3) Explore a way to pay attention to the basic construction of the rule of law.4) Explore a way to put power into the cage of the system of the rule of law.5) Explore a way of building the rule of law and morality complement each other, complement the rule of law of each other.6) Explore a way that a guider overall responsibility, ways of building the rule of law like a chess game. First of all, it points out the main short board of the rule of law in H city which contains 3 parts.1) The level of rule of law in the party members and cadres needs further improvement.2) The rule of law team of the implementation of laws and regulations need to be further improved.3) The people’s legal literacy needs to be further strengthened. Second of all, it analyzes the cause of formation which contains 3 parts.1) Party members and cadres to use the rule of law thinking and the rule of law awareness needs to be improved.2) Rule of law team to maintain the ability of the rule of law to maintain fairness and justice is not strong enough.3) The environment of the law of respect for law and law is not yet fully formed.The forth part (the forth chapter) is the countermeasures to speed up the rule of law in the local administration of H City. First of all, it summary introduces the comprehensively deepen the overall goal of the construction and scientific path of the "H city’s rule of law". Secondly, it proposes the countermeasures and suggestion of "party’s leaderships of the five major lines of construction", which is from the perspective of ruling by law, administration according to law, justice, democracy at the grassroots level, publicity and other five line collaboration to promote city’s construction of the rule of Law. New progress was made in the five major lines.1) Adhere to the leadership of the party, and strive to achieve new progress in the comprehensive improvement of the ability to govern according to law.2) Strengthen administration according to law, and strive to accelerate the construction of the rule of law to make new progress.3) Promote justice and make effort to improve the judicial authority and credibility of the new progress.4) Develop grassroots democracy and make effort to strengthen the management of the masses at the grassroots level to achieve new progress.5) Deepen the publicity and focus on building the socialist legal culture has made new progress. Thirdly, it proposes the countermeasures and suggestions of improve "Party leadership and overall type" of rule of law in H city from the perspective of the rule of law system and mechanism.1) Comprehensively deepen the clearly defined responsibilities of the Party Committee Organization and leadership system.2) Constantly optimize the function and working mechanism of the leading group.3) Strengthen the main responsibility for the implementation of the unit of responsibility.4) Give full play to the role of other social forces.5) Focus on improving the assessment system of local government by law construction.6) Explore the rule of law to build a new field of Party committees actively. 7) Lay a solid foundation for the rule of law effectively.8) Make great effort to make form of a good working atmosphere of the rule of law.The fifth part (the fifth chapter) is conclusion and prospect.
