Study On The Problems And The Countermeasures Of Illegal Constractions In Pingshan New District Of Shenzhen

The road of dealing with illegal constructions problems is rugged and long. The problems have caused troubles in every city’s government, which Shenzhen is no exception. Since the reform and opening up and with the development of urbanization in Shenzhen, the dispute or even conflict that caused by illegal buildings is becoming increasingly fierce. The illegal constructions not only infringe both the public’s legal and common interests, result in difficulty in administrating, but also seriously restrain Shenzhen’s further development. Finding effective countermeasures to cope with the illegal buildings’ problems and successfully carrying them out are greatly meaningful to alleviate social contradictions, safeguard the legal rights and interests of the public, and build a harmonious society.This dissertation consists of five parts. In the first part, the author firstly clarifies the background and significance of this study, then introduces the measures that have been taken by government abroad to cope with the illegal constructions problems, and summarizes the research actuality which has been done by domestic scholars. In the second part, public governance theory and procedural justice theory are chiefly introduced, at the same time, by fully studying relevant laws and regulations, definition of the illegal buildings is made while perils are emphasized according to the writer’s experience. In the next part of the dissertation, the writer focus on analyzing the current situation of Pingshan New District’s efforts to deal with the illegal construction and the difficulties they meet. In the fourth part, countermeasures in five aspects are provided in order to cope with the illegal construction problems, including:improving the system of laws and regulations, providing more ways for people to participate in govern, standardizing law enforcement procedures, offering better supporting measures and working harder in promoting relevant laws and regulations. Last but not least, there are the conclusion and the vision of futurity.
