Since the industrial revolution, human were unprecedented transformation to nature, the unprecedented development of the productive forces at the same time, the natural ecological system happened great changes, the forests disappear, wetland degradation, soil erosion,drought and water shortage, frequent floods, global climate change warm and serious ecological crisis. The eighteen major conferences of the party put forward to strengthen the propaganda and education of ecological civilization, and enhance the people’s awareness of conservation, environmental awareness, ecological awareness, the formation of a reasonable consumption of social fashion, and create a good environment for the protection of the ecological environment. This important discussion points out that to promote the construction of ecological civilization, it is necessary to strengthen environmental education. By means of education enable people to understand the environment, understanding of environmental issues, improve people’s awareness of the environment, access to controlling environmental pollution and to prevent new environmental problems of knowledge and skills, by members of the society common efforts to protect the environment.At present, our country’s environmental education legislation practice is still in the primary stage. First, environmental education in mainland China no environmental law only some policy documents or only in the individual provisions related to some principle provision, at the local level only four places introduced local regulations on environmental education, resulting in environmental education in our country, for lack of systematic and operability. Secondly, there is no perfect environmental education fund system to ensure the smooth and sustainable development of education in mainland China. State provides only the foundation for environmental education will be included in the government budget, single source of the fund and no quantitative the end for what percent of the budget, is also not clear who will be in charge of the fund and the fund’s main purpose. Again, in our country, the environmental education system has been initially established, but overall education environment presented a school education light social education, professional education rapid development of basic education development is slow, resulting in a low, the environmental awareness of citizens as a whole. Finally, in violation of the environmental education, lawsand regulations of the departments and units, only to the unit were informed criticism, the provisions of punishment without liability to the authorities responsible for the individual, it is difficult to play a deterrent role, is not conducive to the implementation of environmental education. At the same time, the citizens of our country lack of environmental knowledge,environmental awareness is weak, only rely on citizens to consciously improve environmental awareness, awareness of the importance of environmental education needs a long process. To strengthen environmental education legislation and improve the legal system of environmental education is the fundamental guarantee for the smooth implementation of environmental education. There is an urgent need for our country to introduce a national level of environmental education law, with the national compulsory force to ensure the effective development of environmental education.In this paper, the mainland and Taiwan of China environmental education legal system comparative perspective, by analyzing the existing problems in the mainland of China’s current legal system of environmental education and the present problems, analysis of Taiwan region and improve the environmental education legal system and advanced by can learn from the experience, and then compare the legal system of environmental education in mainland China and Taiwan the comparative study from the legislative purpose, fund system, certification system,organization and responsibility, reward and punishment and other aspects, so as to improve the mainland legal system of environmental education, improve the legal system of environmental education advice, legal guarantee for national implementation of environmental education, the environmental education in our country according to the law.
