Our country is experiencing a transition period of labor relations, workers’ rights consciousness have Enhanced obviously, labor conflict events continue to occur, The collective bargaining system is just the suit way to workers and enterprises, It is also a effectively way to resolve contradictions with a modulate and coordination way, But in the present stage, government’s role orientation in collective bargaining is error, which is produced some problems seriously and hindered the development of collective bargaining.In this paper, The theme is the role orientation of government in the collective bargaining,It depends on the labor and capital relations theory, government intervention theory and modern government functions theory, Pointed out and analyze that questions when the government orientation in collective bargaining problems, by introducing status and role in foreign governments of collective bargaining, I hope the government can clarify its role in collective bargaining and inspired by it’s function, Finally, the emphasis of the government should put forward their own two aspects : strengthen their sense of responsibility in collective bargaining and improve construction-related in the collective bargaining system: First, the government should clarify their position and follow the principle of collective bargaining, it’s fair principle and scientific principle of reciprocity, both favor the weak and the comply with principles of public interest and appropriate intervention principle; Second, the government in collective bargaining should to re-orientation, including strengthen the sense of responsibility and improve the institutional framework, Strengthen the responsibility of the Government’s can from four aspects :analysis of legislation, trade unions, employers’ organizations and overall, Improve the institutional framework to the whole process of collective bargaining from service, co mmunication, supervision, relief; third, I hope the government can correctly orientation their role to promote the full implementation of collective bargaining, effectively resolve labor conflicts, build a harmonious labor relations.
