Our Energy Security Legal System Research

Since the ancient times, the road of human civilization is accompanied by the development of energy and move on. And the survival of human development cannot leave the energy. The safety of energy or not relations with the development of economy and culture of a country.It is important to establish and improve the legal system of energy security.It is also a common practice in many countries around the world.In recent years, our country has initially established a legal system of energy security, but it is not very perfect. Through research energy security legal system, this paper aims to analyze the problems existing in the system and put forward the author’s idea on how to perfect the system.This chapter firstly introduces the origin and meaning of the word "energy security" and lists different views of the scholars on energy security.At last considering the essences of this article, the paper illustrates the author’s point of view. Second, the theory of "sustainable development" and "resource security" is the theoretical foundations of the legal system of energy security and is analyzed. Finally, the paper points out the significance of researching on energy security legal system. Then in this paper, the authors present the energy security of China’s legal system of analysis, draw the deficiency existing in the legal system of China energy security, that energy security, the legal system is not perfect, some provisions lack of operation, the legislative purpose is not clear, in aspect of the legal system of energy reserves, renewable energy and other shortcomings.Nowadays, the legal system of energy security in China has achieved great success, but there are still many deficiencies and shortcomings. This paper takes the United States and Japan as an example to introduce the energy security legal system of the two countries, and makes a comment on it. The United States and Japan, the common advantages of these countries are developed energy security legal system and a variety of energy security system of great importance. The author believes that the legal system of China’s energy safety of construction and should improve the selectivity of foreign legal system of energy security should draw lessons from it, which is to improve China’s energy security, the legal system has an important significance. Through the above statement and summary, the author believes that the construction and improvement of China’s energy security legal system should adhere to the principle of sustainable energy development, people-oriented principle and the principle of energy security and environmental protection. In terms of specific recommendations, the author believes that in addition to the introduction of energy law to improve the energy law system in China, but also to improve the specific legal system of energy security, and thus to protect the energy security of china. Need to improve the specific energy security legal system: to establish the legal system of energy reserves, improve the energy conservation legal system, establish integrated energy emergency legal system, perfecting the legal system of energy-saving, strengthen legal system of international cooperation in energy security. Finally, the author summarizes the main content of this paper and the shortcomings of the research, and looks forward to the development trend of China’s energy security legal system. Through the joint efforts of the government, enterprises and individuals, to realize the sustainable development of energy utilization in China, and to ensure the safety of our country’s energy.
