Modern State And Involution Of Grassroots Petition

There are tow views in the Xinfang research, one is the “Weapons of The Weak”, which is in the light of Contentious Petition, the other is Nationalism interpretation for the Governance. The paper combines the two views in the way of Nationalistic narration, in order to overcome the single view in the research of Petition, in which there is no the social view. In this paper, the Grassroots Petition is the main study object, which is researched in the analytical framework of “State—Society”. For the one hand, the State could shape the logic and governance pattern of Contention, as well as the behavioral preference of Contentious subjects. For the other hand, the high-speed developing Society Organism plays a counteraction on the State, such as weaken, hold up and contend with the State Power. The country will be reinforced itself in the light of Society’s counteraction strengthens, but the resilient potential energy the Society will get ultimately.Reviewing the representative literatures of Xinfang in recent years, this paper have explored its nationalistic perspectives, and find the inter logic of Xinfang based on the angle of view, which stipulates and restricts model and internal impetus between the three factors of State, Local Government and the petitioners, which also leads to the Involution of Grassroots Petition on contemporary China. Thus the whole Petitionary Institution represents to us the characteristic process: origin—development— maturity—involution—transformation, which could be mainly but not only ascribed to intense shaping outcome by the State, and the involutionary effect is firstly made by the resilient potential energy. There are two primary theory paradigms in which Society could reacts on the State, the one is the Dialectical relationship between State and Society of the Marxism, the other is the State Capture. But the former is general, and giving no more details on how could State be reacted. The concept of State Capture could only explain the behavior of the group of Interests Distribution, or rather, the political practice. Based on the Analysis Framework of reactions of Society, it argues that the Grassroots Petition is conceived to be able to achieve three fundamental features, this is, on the way to Involution, the outward expression and inter logic of Involution. In the end, the author argues that the essence of Involution is rooted in the general trend, in Contemporary China, of the Society’s Capture on the State.Although the high-speed Society Organism is breaking through the scope placed by the State, but it cannot exist without the Country, just as the State cannot leave the Society, although it reins over the Society. Thus they are mutual contradictory and cooperative. The Society itself does not fight against construction of the country under the rule of law, the Society, indeed, rely on it. On the contemporary Chinese context: the State gobbles up the Society and the station that State cannot do that completely, the real meaning of the Society’s contention is oriented from the contradiction between “the Spontaneous Expanding Order”(Hayek,2000,p7-18) and the governing pattern under the single powerful center, which makes the possibility for the Society’s capture on the State.In the passage, the factor of “Land development and Accommodation” has been the first course for the Petition Boom, based on the statistical data from 5-6 month in 2004 and unlawful Petition statistics from 2013-2014, which are accordance and relevance to each other. These Petition Boom originates from impulse of local governmental development and land finance, and is deduced by the factors such as depression of real estate market, local governmental debts and deceleration of land finance. This paper reviews the massive rectifications for the Cultural Revolution which were individually dealt by the Central Committee of CCP involved 127 million. No matter the Petition Boom or the massive rectifications cannot evolve the institution for negotiation. Thus the mission is for the introduction in which the Petition Boom, researching problem and hypothesis are put forward.In the chapter two, the Petition is regarded as an inevitable method of grassroots governance in which there is ainternal logic that shape the local governance mechanism in the chapter three, and the preference model of petitioners in the chapter four. The chapter five is a transition, in which three characteristics have been ascribed,involving no-evolutionary institutions, inefficiency and state involution. The involution of Grassroots Petition is accord to these characteristics, because of the suppress and control leading to the great power of bounce. There are contradictions between alive social organism and state, between“the Spontaneous Expanding Order”(Hayek,2000,p7-18) and the governing pattern under the single powerful center, which makes the possibility for the Society’s capture on the State.In the end, the paper reiterates that the meaning of the society, not only because the state and the society are mutualistic symbiosis, and they cannot existindividually, because the modern public affairs are so complex and complicated in the transition that they will augment in order of magnitudes, The more resource should be input if the society is forbidden partially, thus the cost should be increased for the national governance, even they could devour the outcome of economic development; but also to caution the fact that the state have been controlling and suppressing the society in contemporary China, especially by the policy and ideology in the recent years the public opinion space had been destroyed originated from the 1990 s to the 2010 s.Thus, “Back to society” means not only liberation for the society, but also the liberation for the state itself, which is the inevitable challenge for the construction of the country under the rule of law and for the national management modernization.
