A Study On Protection Of The Rights And Interests Of Telecommunication Consumption

Telecom industry is a basic industry of national economy and people’s livelihood with natural monopoly and scale economy. For promoting the healthy, rapid and orderly development of the telecommunications industry, we not only tointroduce effective competition into the telecoms industry, through the market mechanism with the "invisible hand" to achieve balance and adjust themselves, also need government to supervise and regulate the telecom industry moderately, in order to realize and play to the role of legal supervision function. In such a transaction, the transaction subject unequal status, as well as difficult to adjust, will inevitably lead to the interests of different telecommunication consumers continue to be violated; it is difficult to protect the legitimate interests.Nowadays, the development of the telecommunications industry by leaps and bounds, to the vast number of consumers has brought many convenient, however, which makes consumers begin to pay attention to their rights, and through various ways to claim their rights. The article whichfrom the development of the telecommunications industry and the development situation of the telecom industry analyzes the current violation of consumer rights and interests of the industry, and the reasons, studying the experience abroad, points out that because of the unequal status between telecom operators and telecom consumers, telecom operators use of format contract one-sided deprived of telecom consumers rights, so the regulation of government is necessary obviously, the purpose of government regulation is to create a environment in fair competition, and protecting the rights of telecommunication consumers eventually. On this basis, this paper discusses how to build our country telecommunication consumer rights protection mechanism. Firstly, improve the telecommunications legislation designed to protect consumers’ rights. Secondly we will deepen reform of the telecommunications system,introducing competition mechanism, to break the monopoly, separate government functions from enterprise management, make the telecom industry independent operation, ensure fairness and justice. Thirdly, we should make it run in the sun strengthening the independent regulation of the telecommunications industry. Fourth, improve the system of information disclosure transparency, to protect consumers’ right. Fifth, improve the judicial relief way, clear consumers’ relief channels.
