Legal Govemance Of The Communication In The Network Public Sphere In China

In the second session of the World Internet Conference,General Secretary Xi Jinping pointed out that with the internet closely linking the economy and society and people’s life, a stable and secure cyberspace is of great significance for both nations and the world. Cyberspace is similar to the real society, which is not only to promote freedom, but also to maintain order. The Internet is intangible, but the people who use the Internet are tangible.Marx believed that society is the product of the interaction between people. Therefore, the governance of the network in the field of public communication, in fact, is the governance of people. Cyberspace is not a place “beyond the law”. Virtual as it is, people who use it are real and should comply with the law and have clear ideas about their rights and obligations. With respect to the rights of internet users to exchange ideas and express their wishes, a good network order should be built by law, which is conducive to the protection of the legitimate rights and interests of the Internet users and promoting social harmony.From the perspective of the socialist rule of law and the modernization of national management, with the analysis of communication difficulties in the network public sphere, this paper finds that network public sphere have many problems, such as irrationality and conformity, decentralization and fragmentation, entertainment and consumption and so on. The reasons are as following: in reality the ways of practice are various and the expectations are systematically deviated and the definitions are theoretically limited. Therefore, the normal implementation and maintenance of social norms are disturbed, which intensified social disorder and conflict. For the modernization of national management and the building a harmonious society, it is an urgent need to use the socialist rule of law to regulate the network public sphere chaos. The comprehensive, sustainable and fundamental socialist rule of law will bring citizen the rights to politically participate and publically express their opinion, and promote the common role of the network both self management and supervision of the others. This paper believes that there is still much space for the network security legislation in our country. For people’s communication in the network public sphere, it is necessary that the work of legislation, modification and the abolition of the law will be carried out and the citizen’s awareness should be improved. With guidance of Marx’s law and state governance and the concept of Chinese characteristics socialist, the socialist legal governance in the network public sphere will be strengthened and the chaos of network public exchange will be controlled. From the legislation and enforcement of law, the right of citizens to participate in the network public sphere will be protected, the behavior in network will be regulated, and the practical solutions to communication difficulties in network will be explored, a harmonious socialist society and socialist country under the rule of law will be built.
