t:In China, women’s equal right to employment is widely stipulated in Law. Nevertheless, in real life women are commonly discriminated in employment and they are not effectively protected while their rights are aggrieved. And based on that, Starting with The First Case of Gender Discrimination in Employment, the author put forward the problem of handing employment discrimination lawsuits in legal practice in current,and explain the related theory research about the right to equal employment and employment discrimation in international and domestic,Through learing the experience,the author proposed the definition of her own in equal employment right and employment discrimination.By collecting vast majority of cases which relate to the female employment discrimination, analyzes manifestations of female employment discrimination both in job-hunting and over the work, the response of women who suffer discrimination and the way of cases handling, and then summarizes the reasons why female suffer employment discrimination in biological difference and social division and macroscopic employment situation and law-making and intensity in law enforcement. In the end, drawing on the problem in cases, the author puts forward the suggestions in improved legislation and clarified responsiblity of labour administrative department and improved legal proceeding and limit employers’employing autonomy to improve equal employment right for women.
