A Study Of The Legal Protection Of The Higher Education Quality

The number of higher education students increased sharply with the quickening pace of the development of higher education in our country, all kinds of the gross enrollment ratio of higher education in China has reached 34.5% in 2014, the Total of the students who studying in the higher education was 34.6 million. The proportion growth dynamically and will be rising every year. After decades of development, our country have set up a talent training system basically which combined different levels of corresponding education with vocational education and ordinary higher education, and successively promulgated many laws and regulations to regulate and guide the development of higher education. We have promulgated many laws such as 《The education law of the People’s Republic of China》、《Higher education law of the People’s Republic of China》、《The vocational education law of the People’s Republic of China》 and 《Private education promotion law of the People’s Republic of China》 since 1995.Our country seems to have set up a perfect system of the higher education training from the surface. However, the actual situation is that the students’ theoretical foundation is weak, lack of practical experience and disconnect with the development of the society’s need. In the field of scientific research, there are many academic corruptions. Lack of ability to apply after the graduates into society and get a situation that "graduation" means "unemployed".These entire messes make the country’s scarce education resources waste, and let the valuable human resources consumed innocent. We constantly reflection:Why higher education will become so badly? Why so much ugly education corruption also constantly happened? The higher education quality was the key; the quality of the higher education is the lifeline of the development of colleges and universities, is the hope of the nation and the historical mission of the higher education! Firstly I expatiates the higher education’s quality and the connotation of higher education quality assurance, then analysis the present stage of the quality of higher education in China and its causes and establish the law of guarantee the quality scheme of higher education finally.Through the analysis of this article, I think the cause of China’s higher education quality problem mainly includes four aspects:Firstly, serious shortages of financial investment and education when the higher education scales rapid expansion. Secondly, the goal of the higher education talents training disconnected with the social demand diversity. Thirdly, the teacher’s team construction not adapted the development of scale. Finally, a lot of teachers "main woke" horse the "side work". These interactions lead to the quality of higher education declining in China. It is a system engineering to guarantee the quality of the higher education, need the whole society coordinate efforts. It is particularly critical to provide effective legal protection for the training quality of higher education. On the one hand, we should formulate《The higher education funding security law of the People’s Republic of China》, safeguard enough input to the funding of higher education from the legal. On the other hand, we should formulate 《The quality of higher education act of the People’s Republic of China》, ensure the institutions of higher learning consciously perform their duty of higher education quality assurance. In addition, the colleges and universities also should strengthen the construction of internal rules and regulations. The external legal protection is the key and the system of the internal security is the foundation, both supplemented and acted each other, promoted the development of higher education and the improvement of quality jointly.
