Research On The Safeguard Mechanism Of Equal Educational Rights Of Migrant Workers’ Children In City

With the rapid process of urbanization influenced by reform andopening and continuously developing market economy, more and morerural labor force is moving to cities for a new life. The rapid developmentof cities and high quality of life "lure" more and more migrant workers, inthe form of moving with the whole family instead of former one of movingalone. While in this process, a new problem has emerged and becomeincreasingly prominent--how to ensure migrant workers’ children’s equaleducational rights in city.Guaranteeing the equal educational rights of migrant workers’childrenin city is essential for implementing educational equality strategy,promoting social fairness and justice, developing China a powerful nationof human resources and building a harmonious socialist society.In the aspect of politics, sociology and law, this paper aims to discussthe construction of guarantee mechanism on equal education rights ofmigrant children by researching migrant children’s educational rights incompulsory education stage and analyzing features and realistic difficultiesof equal educational rights.This paper argues that the equality refers to that children of migrantworkers and urban residents’ children (in the compulsory education stage)shall share equal educational rights and the guarantee mechanism should be attached legality, equality and compulsiveness. However, currently,inequality still obviously exists in educational opportunities, conditions andevaluations. An important reason leading to the inequality is inefficiency oflegislation and mechanism with existing binary segmentation of thehousehold registration system as the fundamental reason and imperfectcompulsory education financial system as main reason.Suggested in this article, safeguard mechanism of equal educationalrights should be constructed in the legislative, administrative and judicialaspects. Legislative safeguard suggests that educational legislation shouldbe more concrete and operable by defining legal liability of various roles ineducation, making education act of children of migrant workers orperfecting current education acts with relevant clauses. Administrativesecurity is the key point which means the government and otheradministrative departments should accelerate the reform of the householdregistration system, promote the process of urban-rural integration andimprove existing supply system of education. As the most effective reliefsupporter, judicial safeguard can provide a solid guarantee for realization ofeducational equality by constructing a relief system covering constitutional,administrative and civil litigation fields.
