In the information age,the pace of technological upgrading is faster.Industry-University-Institute Cooperation is becoming a new way of knowledgeproduction and technology transfer as an important component of nationalinnovation systems form.How to achieve better research cooperationinnovation,reduce the intellectual property risks which universities,researchinstitutions face has become the focus of academic attention. At present,scholars study the risk of intellectual property rights from a legal view.Howenterprises deal with the conflict of intellectual property laws.But little studyfrom the perspective of intellectual property risk management. In reality,universities, research institutions loss intellectual property seriously, especiallytheft of other units, with staff deployment. Although the law on intellectualproperty protection in China, but the Cooperative innovation often involves tacitknowledge, which often requires relational embeddedness to manage outsidethe contractual relations. Moreover relational embeddedness is objectivelypresent in Industry-University-Institute Cooperation. Many universities,research institutions embedded do not understand the concept of relationalembeddedness, what are intellectual property risks, intellectual property risksin what effect will intellectual property risks. There are research scholars fromthe perspective of relationship that relational embeddedness can reduce theopportunism, while some scholars from the perspective of knowledgemanagement that relational embeddedness will improve the intellectualproperty risks. This article is based on these realities in the confusion and lackof theory, attempts to draw the theory of relational embeddedness in neweconomics to research the impact of relational embeddedness to intellectualproperty risks, in order to provide universities, research institutions with thetheory and practice guidance.This study based on the literature review, first introduced the currentstatus of relational embeddedness in the cooperative research, has defined the concept relational embeddedness, and pointed out the specific dimensionsof the relational embeddedness; Secondly, from the management point of view,put forward the specific dimensions of intellectual property risks which underthe sharing of intellectual property rights. In addition, according to literature,proposed two different ways for the control of organize cooperation. Finally,this paper builds a model of relational embeddedness affecting intellectualproperty risks in the Industry-University-Institute Cooperation, with control wayas an intermediary variable risks. Use exploratory factor analysis, validationfactor analysis and structural equation model analysis method to test on themodel.This study concluded that: relational embeddedness can be divided intotrust, information sharing, tie strength three dimensions and intellectualproperty risks can be divided into technical personnel flow risk, andinnovation-related risks of intellectual property theft, innovation-unrelated risksof intellectual property leakage, and intellectual property investment risk fourdimensions. Control can be divided into formal control and social control twodimensions. Different dimensions of the relational embeddedness affected onthe intellectual property risks in differences. Relational embeddedness doesnot necessarily lead to negative intellectual property risks.
