"Labor Contract Law" the implementation in January 2008, the enterprise workers increased proportion of the labor contract, to better safeguard the legitimate rights and interests of workers. But in practice, there are still a large number of workers did not sign labor contracts, because of lack protection of the labor contract, lead to difficulties of obtaining evidences, the difficult problem of rights protection is still very prominent. So, what kinds of factors can affect the workers to sign labor contracts?The study summarizes since the founding of New China, the legislation development process of China’s labor contract management, preliminary analysis of the enterprises workers to sign labor contracts situation since the "Labor Contract Law" implemented, summarizes the negative impact caused by lack of the labor contract. Using 2010 Chinese General Social Survey(CGSS) data, the study selects qualified research samples from 1545 samples, according to social-ecological systems theory, establishes a framework for systematic analysis, made research hypotheses, from the dimensions of gender, age, education, business ownership, industry, region, etc, analysis of the situation of workers of the current to sign labor contracts, using logistic regression analysis methods, analyzes the factors affecting the workers labor contracts, summarizes the significant factors affecting the workers of to sign labor contracts. Main conclusions:1. Aspects of individual characteristics. Age has a significant effects on workers to sign labor contracts, with age the probability of the workers to sign labor contracts fell after first rising.2. The micro level.(1) Human capital is stronger, the greater possibility of workers sign labor contracts. Education will significantly affect the workers to sign labor contracts, the probability of highly educated workers to sign labor contracts will be higher; the possibility of "non-farm work hours" and signed a contract of a worker is positively correlated.(2)Also significantly affect the individual identity of workers to sign labor contracts of workers: the possibility of non-agricultural workers to sign labor contracts is significantly higher than migrant workers; managers are more likely to to sign labor contracts compared to ordinary workers; the possibility of union members to sign labor contracts is significantly higher than non-union members.3. The meso level. Ownership and size of enterprises to sign labor contracts for workers affect significantly: the probability of foreign, Hong Kong, Macao and Taiwan enterprises, state-owned of enterprises workers sign contracts significantly higher than collective enterprises and private enterprises; as compared with micro-enterprises, small, medium and large enterprises the possibility of signing contracts sequentially to increase of workers.4. The macro level. Regional factors have a more significant impact on whether the workers sign a labor contract: the possibility of the eastern region of workers signed labor contracts is significantly higher than the western and central regions.Finally, according to the results of empirical research, the study puts forward some suggestions from five aspects: strengthening labor and employment supervision in small and micro enterprises and private enterprises; strengthening inspection of law enforcement of migrant workers to sign labor contracts, and enhancing awareness protecting migrant workers; strengthening construction of trade unions and attracting workers to join, giving full play to the role of trade unions; strengthening legal advocacy, enhancing enterprises compliance awareness and social responsibility; strengthening labor and social security inspection team construction, increasing labor and social security supervision enforcing work intensity.
