The Research Of Spillover Effect Under The Protection Of Intellectual Property Rights

Under the background of economic globalization, technological progress is the ultimate source of long-term stable economic growth, a country’s technological progress can be realized through two channels, namely the enterprise to carry on the independent research and development, organizational innovation and imitation of the overflow of advanced technology. And the protection of intellectual property rights is the important factors influencing the technology spillover effect, is to improve the technical level of importance. The protection of intellectual property rights not only affects a country’s own independent innovation, will directly influence the development of multinational companies path, in the international trade, foreign investment and technology transfer to make the best choice. International trade and FDI are two important channels of international technology spillover of R&D, under the strength of the current intellectual property protection in China, the two channels of technology spillover on the influence of China’s total factor productivity has very important practical significance.This article according to the Ginarte and Park classification method to measure the level of protection of intellectual property rights in China, and through the research method of the previous scholars to modify nominal strength of intellectual property rights (ipr) protection, calculated China’s 1998-2012, the actual strength for the protection of intellectual property.Selection of total factor productivity as the dependent variable, six R&D spillover effect of the independent variables affecting the multivariate linear regression, the regression results show that the productivity is mainly influenced by stock of domestic research and development, China’s current level of human capital on foreign technology absorption capacity is not strong, and enhanced the protection of intellectual property rights can increase the degree of technology spillovers of foreign R&D stock.This paper puts forward that our country should increase investment in research and development of domestic, encouraging independent innovation, through perfect intellectual property legislation and enforcement, at the same time attract more advanced technology to our country’s export enterprises or investment, enhance China’s enterprises to absorb advanced technology using ability, improve the level of technological innovation.
