Analysis Of Intellectual Property System In The Collaborative Innovation Of Hunan Regional Science And Technology Support

The Chinese Communist Party’s 18 th Congress formally proposed the strategic decision of "Innovation Driven Development", and further emphasized the importance of collaborative innovation.Scrutinizing the relationships between the Intellectual Property System(IPS) and Regional Science and Technology Collaborative Innovation(RSTCI) as national strategy is not only a momentous strategic choice, but also the inevitable course of constructing an innovation-oriented Hunan.The RSTCI pattern formed by innovators(governments, universities, scientific research institutions, social intermediary organizations, etc.), which has the superiorities of integrated resources, shared information and complementary advantages, has already been promoted in Hunan province. However, the problems and difficulties in the delimitation of intellectual property and identification of ownership are restricting the sound development of collaborative innovation.In order to achieve the collaborative effect of “1+1>2”, Hunan and even China need to intensify the studies of the relationships between IPS and RSTCI so that the supportive role of IPS can be brought into full play.At present, there are various researches regarding to innovation, regional collaboration and revolution of IPS both in China and abroad, but the studies concerning the relationships between IPS and RSTCI, especially how to bring the IPS to play a significant supportive role in RSTCI, can hardly be found.As the motivation and supporting mechanism which would lead to the development of innovation, IPS itself is a complicate dynamic system, and there are new difficulties presented in the pattern of RSTCI need to be solved.This paper firstly introduced the backgrounds and current situation of the research, then it tightly focus on the studies of the issues — such as indistinct delimitation of intellectual property, vague income distribution pattern, unscientific management of university property, imperfect social intermediary service system, and unproductive incentive utility of intellectual property — presented on the progress of IPS supporting the RSTCI in Hunan Province using the methods of theoretical analysis, comparative analysis and bibliographic retrieval. At the end, this paper draw an analysis conclusion that these problems are primarily due to the following reasons:the complexity of collaborative innovation itself, the difficulties in identifying the outcome ownership of collaborative innovation, the technical barrier betweenscientific research institutions and enterprises, the neglect of collaborative innovation on intellectual property legislation, the insufficient coordination and regulation of government executive departments in the intellectual property of collaborative innovation, etc. Drawing on the experience of both domestic and overseas theoretical research achievements, this paper concludes the countermeasure of IPS revolution which supports the RSTCI in Hunan Province, that is to improve and construct the systems like sharing intellectual property system that will benefits each innovative entity, collaborative innovation intellectual property marketing system, intellectual property society service system and intellectual property public management system.In summary, the purpose is to steadily promoting the development of an innovation-oriented Hunan during the process of strengthen the supportive role of IPS on RSTCI.
