A series of technological breakthroughs in modern molecular biology,especially the rise of crop transgenic technology,make agricultural bio-economy one of the most promising fields in the world.Despite of the disputes on the safety of transgenic technology and its adverse impact on ecological environment and the disagreements in application and promotion of transgenic crops among different countries around the world,all countries are actively carrying out R&D and innovation on crop transgenic technology in order to control the commanding point of technology innovation in light of its enormous commercial value in the future.As a country with abundant agricultural resources,China has some natural advantages on crop transgenic technology and industrial development.However,compared with developed countries,major problems such as insufficient technology innovation ability and imperfect intellectual property protection system hold back the development of crop transgenic technology and innovation.At present,urging problems have incurred in China in the development of transgenic crops industry,that is,how to effectively exert the incentive effect of intellectual property protection system and how to effectively stimulate the innovation intention of innovation subject and transform it into improvement of innovation capability.Based on research on theories of technology innovation,this paper aims to enable us to understand the rules of innovation mode selection of crop transgenic technology innovation subjects.Meanwhile,with the combination of current situation of technology innovation of transgenic crops in China,this paper mainly focuses on the research on intellectual property protection system,analyzes its mechanism and effects on innovation mode selection of different innovation subjects and tries to establish a system to encourage innovation subjects to improve their innovation intention and capability.The research direction and achievement of this paper have profound significance in guiding the improvement of the innovation ability of crop transgenic technologycrop transgenic technology innovation subjects and the promotion of sustainable development of transgenic crops industry in China.Current researches on the influence of intellectual property system on innovation at home and abroad still mainly focus on the influence of the system on technology development and industrial innovation modes with little attention paid to the internal motive of selecting innovation modes of different innovation subjects and the internal connection in the intellectual property protection system.This paper focuses on the investigation intofactors with impact on selecting innovation modes of crop transgenic technology innovation subjects and the important role of intellectual property protection,endowing novelty in perspective of the research.Meanwhile,this research focuses on the two important theories of technology innovation and new institutional economics,mainly studies the new plant varieties brought by the development of crop transgenic technology,carries out empirical research and explores the internal law of selecting original variety innovation or derived varieties innovation.The research conclusion enriches relevant theories and has practical significance to perfection of intellectual property protection system and improvement of innovation ability.Research contents and methods in this paper mainly include: to carry out comparative analysis on the differences in development mode of crop transgenic technology innovation and intellectual property protection mode in major countries at home and abroad from the perspective of theoretical summary,to conduct empirical research on potential factors affecting the selection of innovation modes of innovation subjects with the use of Logit model and from the two aspects of public research institutions and private enterprises,such as intellectual property protection,R&D investment,R&D cost,market promotion.The regression analysis was carried out using part of quantitative data to verify the empirical results of the analysis.Questionnaire investigation and data reductionis adopted to learn the influence of intellectual property protection on R&D investment intention of crop transgenic technology innovation subjects,variety right application intention of and achievementmarketization intention to study the ways how intellectual property protection affects the innovation modes of crops transgenic innovation subjects.And based on the Stackelberg Model,analyze the innovation performance of the original and derivative innovation in the industry competition environment.Finally,the paper proposes policy suggestions to improve intellectual property protection system from the perspective of construction of national independent innovation system applicable to crop transgenic technology in China.The conclusionindicates that the main factors that,among the affecting factors,institution'scharacter,strength of intellectual property protection,R&D investment,cost of genetic materials and variety approval procedures and have significant impacts on the selection of innovation modes of crop transgenic technology innovation subjects in China,among which,intellectual property protection is one of the most important factors.Meanwhile,intellectual property protection also indirectly affects selection of innovation modes of innovation subjects by means of affecting R&D investment intention,application intention of variety right and intention of market promotion.The theoretical explanation is mainly embodied in the effect of intellectual property protection on the innovation performance.Based on the conclusions from empirical research and the actual situations of development of crop transgenic technology innovation and intellectual property protection in China and with full consideration taken over the influence of intellectual property protection on the innovation modes of technology innovation subjects,this paper proposes that the construction of national innovation system of crop transgenic technology where enterprises are the main body,plant variety right value chain is the core,Industry-University-Research cooperative innovation and sharing of intellectual property rights will be an inevitable way for the development of transgenic crops in China.
