Study On The Problem Of Protecting Farmers’ Rights In Land Transfer

At the present stage,China’s social economic development has entered a transition period, especially the rural economy is growing rapidly.So,proper land transfer is the only way to stabilize the rapid development of modern agriculture,and this is an important step to impel the rural land reform and rural economic development. The key to solve the problem of land transfer is proceed from the perspective of the interests of farmers, protect and achieve the land rights of farmers effectively.However, at this stage it seems that there are still many flaws in the agricultural land market,The most important issue is the slowly development of the rural land market,land ownership is imperfect,And protection of agricultural land transfer market mechanism is not perfect.These issues are closely linked to the interests of farmers,if the problem of damage to the interests of farmers remain unresolved,the protection and realization of farmers’ permissible interest will become more difficult,thus the development process of rural land circulation and modern agricultural will be hindered.,it’s not conducive to the development of China’s economy and society.With the continued development of land transfer,many domestic scholars shift their attention to agricultural issues,and to protect the interests of farmers has been the focus of attention.This article from the perspective of farmers’ rights in land transfer,and select a number of farmers fieldwork. Analysis of the specific characteristics of the transfer of agricultural land,then from the present situation of farmers’rights,the situation of farmers’damaged rights,and the reason of damaged rights three aspects to hand in,and analysis the in-depth problem between land transfer and farmers’rights.Study found:1.Rural farmers can’t recognize land ownership clearly,most farmers believe that the land belongs to the state,thus farmers’ awareness of defend their own interest is relatively weak,this leads to the farmers don’t have a strong will to protect their own land interests.2.China’s current land transfer program is not very standardized,without a sound intermediary organizations to guide farmers to land transfer,land transfer services can’t keep up with the protection of farmers’ rights,so farmers at high risk of land transfer.3.the most important,government’s compensation for farmers’ land rights protection mechanism is imperfect,rural farmers at the angle of protection of their land interests,their are reluctant to actively land transfer.
