The Normative Research On Enterprise Bidding Process

With the establishment and development of China’s market economic system,bidding system become a fundamental system in our economic activities. But for along time, Chinese enterprises lack of systematic research on the issues related to theimplementation of Tendering and Bidding Law, unable to adapt to China’s rapiddevelopment and connect with the world economy. In order to change this situation,the author will do some simple analysis and research.In recent years, China has enacted Construction Law, Tendering and BiddingLaw, Regulation on the Quality Management of Construction Projects and so on, andhas established levels tangible construction market at all levels, implementednormative bidding specification, rectified market order, toughen enforcement,prevent and govern engineering construction corruption phenomenon from thesource, have made big effect, but there are still unfair competition and operationsuch as violations manipulation, mutual collusion, dark set trap during bidding insome areas, left quality and security problems to the project, this problem should bepaid attention during the height of the state and society, establish and perfect rulesand regulations, continuously improve and perfect bidding management approach,avoid the occurrence of irregularities as far as possible, further standardize thebidding behavior of enterprises.At the first, this paper study the construction project bidding theory and specificprocess of bidding, considering of the project status and features, according toengineering tendering process at present, through using system and the industryanalysis from current comparison at home and abroad, find that there are someproblems during engineering tendering process, principle of "separation betweenrequirements and tendering, bidding and decision-making" and principle of "open,fair and just" cannot reflect quite well, thus affect tender results, further influence the quality of construction.Secondly, analyze and complete construction tendering process on the basic ofrelated process optimization theory, has discussed the normative status of the tenderand make recommendations, improved the existing unreasonable process, puttingforward an integrated, rational and scientific engineering project bidding process.Optimized bidding process represents "separation between requirements andtendering, bidding and decision-making" principle, and "open, fair and just"principles, to a large extent improves project transparency in the tender process.Have made a strict rule on the timetable for the each phases, come up with a morereasonable method for the bidding, opening and evaluation, while added the thirdparty’s supervision check mechanism on project bidding, make sure the tenderingprocess can run smoothly and shorten the time of the project bidding process, hasimproved project tender efficiency, tender results and project quality have gotguarantees.Finally, consider that the implementation resistance of optimized processcomes from the inside and outside of organization system, in order to remove theimplementation obstacles of the management change, puts forward to complete theengineering bidding management method and the detailed rules for theimplementation of related systems from the aspects of macroscopic scale, strengthenthe engineering bidding supervision and management, establish project biddinginformation system, play a better bidding function, and suggested to providequalified personnel.
