The Research Of The Reform Of Industrial And Commercial Administrative Examination And Approval System

Administrative reform is a basic requirement and the inevitable trend foreconomic and social development. The Third Plenary Session of18th NPC stressed,“We should enhance decentralization, deepen the reform of administrativeexamination and approval system, limit the central government’s management ofmicro-affairs. The market mechanism should effectively regulate the economicoperations.The approval must be abolished. For the reserved administrative approvalaffairs, we should standardize management and improve efficiency." In the NPC andCPPCC in March2014, Premier Li Keqiang explicitly requires decentralization andtransferring of200items for administrative examination and approval, which furtherdemonstrates the determination of central government on the reform.On September29,2013, the Shanghai Pilot Free Trade Zone provides the perfectstage for urgent reform of industrial and commercial administrative examination andapproval system. Concepts of " license first and permit after ","negative list" and"one dollar company," are full of expectations to the public for a free trade area. Butthe "lenient admission and strict control" is to the administrative department a largedifficulty. This paper will analyze the defects and deficiencies of the existing industrial and commercial administrative examination and approval system, andcompare successful experience of Shenzhen registration system reform and foreigncommercial registration system. Combined with the actual operation of the ShanghaiPilot Free Trade Zone, the paper will study difficulties in deepening the reform of theadministrative examination and approval system for industrial and commercialdepartment, explore how to further promote the good and accurate control bygovernment’s "visible hand".This paper is divided into four parts. The first part is the introduction. Thesecond part as an overview of industry and commerce administrative examination andapproval system, will give a brief description of the theoretical basis, the evolution、background of the reform and the deficiencies and defects existing in the currentsystem. The third part explains the challenge that business registration trialmanagement model of Shanghai Free Trade brings to the current industrial andcommercial administrative examination and approval system, and combined with theactual operation of the administrative approval system reform pilot in Shanghai PilotFree Trade Zone, discuss the pros and cons of “license first and permit after ","negative list" and other innovative systems and the challenges it might face. Thefourth part proposes innovative ideas and suggestions for industrial and commercialadministrative examination and approval system under the Shanghai Pilot Free TradeZone`s development, and through research on its policies, gives advices for thereform of the system, in order to make our industrial and commercial administrativeexamination and approval system more responsive to the needs of the times.
