The Research Of The Countermeasures Of The Using Right To Cixi Rural Land Circulation

With the deepening development of China’s socialist market economy, many severe problems appeared in the rural areas gradually, one of them is the Homestead circulation system.On the one hand, the city economic scale need to match the support of the land. On the other hand, farmers’ demand of improving the living conditions became more and more urgent. The serious shortage of urban construction land and a large of idle rural homestead became a very bright contrast. Therefore, the further study of homestead circulation system and explore a suitable reform path of the circulation system are imperative. Through the questionnaire survey and the actual visits, This article elaborated the research background, purpose and significance, the research technique and the innovation points by obtaining research data and detailed information and using the existing research results and the method of literature research, normative analysis and description analysis.This paper reviews the present situation of the domestic and foreign research,and elaborated the concept of the system of rural homestead laws and regulations and the related theory.And introducing the utilization status of Cixi homestead,analysis that Cixi homestead has the problem of Homestead Land scattered layout and the continuous expansion of the scale, and the shortage of the super size, and summarizes the reason is the invisible transfer of property rights of farmers and homestead consciousness, a large number of idle land and hollow, farmers’ rights consciousness and the shackles of traditional ideas, the homestead has been free, limited circulation, exit compensation mechanism is not perfect and lack of social security.Then the rural residential land in the process of urbanization at home and abroad to exit compensation experience and Enlightenment for reference.Finally,this paper puts forward suggestions on the reform of the rural homestead circulation of Cixi mode reform.For example, making a comprehensive right registration of homestead, improving the preparation of the overall land use planning ideas and steps, improving the system of laws and regulations, establishing the combining system of rural homestead free and paid use,establishing of limited circulation system of land within the city range and establishing of monetary compensation and resettlement housing a combination of a sound social security system.
