Study On Rights And Interests' Safeguard Of Farmers Lost Land

In the process of national economic construction and the development of the society farmers lost land are those whose farmlands are claimed by urbanization and industrialization. The appearance of the landless- farmers is considered to be a normal social phenomenon for the city's urbanization. In recent years the land acquisition system lags behind and some problems caused by land acquisition are not effectively solved. Because farmers are usually under-compensated, relocation programmed for farmers are insufficient, the rate of the employment of landless-farmers is low and their social rights are protected unsuccessfully these problems make numerous farmers lose land to farm or become surplus labor and marginalized in the social security system. Since their legal rights are invaded there have been incidents of farmer unrest, which affect the development of the national economy and are a major source of social instability. Therefore basing on the phenomenon of landless farmers it is necessary to aim at the existing legislation defects in land acquisition, reform the land acquisition system and build a social security system embracing all walks of life and sectors.This paper begins with an analysis of rights and interests what the farmers should have from different aspects. Basic right is the start of any other rights. The realizations of the basic right of farmers and just compensation for the land collected are based on the rights and interests related to land. The fanners' rights and interests in the course of land collection secure the realization of their basic rights. Then it describes exiting problems of the loss of the rights and interests and analyses the reasons of it including two main faults. One is system problem consisting of development goal? regulations, organizations and procedures, the other is mechanism problem including compensation, sharing of the interests, employment and social securities and supervision. Finally in terms of the duties of government this paper puts forward some proposals on rights and interests' safeguard of farmers lost land namely innovating the system, perfecting the mechanism and fair execution.
