The Research Of Compensation Standard For Rural Homestead Exiting By Different Ways

The countryside homestead bore the famers’ basic living and product function. Along with the urbanization level increasing year by year, the massive influx of rural surplus labor pour into cities and towns. They rely mostly on urban, but keep house in the countryside. Some even "old houses do not fall, news start". Although the area of rural land is narrowed with the urbanization level increasing year by year, the house-site in the countryside is grown. In many areas, the paradox what between the rural population reducing and the house-site in the countryside increasing appears in the process of urbanization. The contradiction between the population and the land using structure is not only to protect cultivated land, but also profoundly affact the development of social economy in our country. Its root lies in the dual urban-rural division of land used system, and lacks the exit mechanism of house-site that adapting to high speed development of urbanization and the process of industrialization. The heart of the exiting mechanism of house-site in the countryside is the determination of compensation standard and the construction of a compensation mechanism, especially for different land exiting way to establish a reasonable compensation standard. Reasonable compensation could increase the motivation, protect plough, protect famers’ rights, and keep the stability of rural society.Therefore, this paper’s purpose is measuring the compensation standard of house-site under different way. The research methods are normative analysis, questionnaire survey and the combination of qualitative and quantitative. The study area is Garden Town of PI. Firstly, summarizing the research of the exiting and compensation for the house-site in the country, defining the relevant concepts, and introducing property rights theory, land rent and land price theory, welfare economics theory. Then analyzing the main exiting way of house-site in the countryside, the basis of compensation and the calculation method of compensation. Selecting typical cases to calculate the compensation standard basis on the land use status of study regional. Namely calculating the compensation standard for farmers who replace the right of house-site, exit in government-leading mode way, and transform house. Then correcting the measure results and analyzing its feasibility according to the local actual situation, the existing laws, and the opinions of farmers and the relevant departments. The conclusions as follow are on the basis of theoretical and empirical studies.(1) The compensation standard of Pi country is low, and the compensation system is not perfect. The reason is that only the compensation of removal house is paid. The compensation standard of house-site exiting that based on this research ideas and methods reflect the land market price level and have a certain reference value. That is the compensation of house-site in the countryside including demolished buildings, other attached objects and the land.(2) Different calculating model can reflect the principle of analyzing different issues. At the same time, Different calculating model can safeguard the rights and the interests of farmers.(3) The compensation of house-site exiting should be aimed at different exiting manner. Only this way, farmers can ensure their own rights and interests in the process of house-site exit.
