A Study On The Institutional Defect And Optimization Strategy Of Environmental Conflict Management

In China's environmental conflict governance,there are a series of institutional defects.At the beginning of the system design,the fuzzy concept in design to environmental governance system is unknown,the original design of the system and the actual results of dislocation and contrast.Some defects in the course of system implementation,the environmental conflict governance effect is difficult to show the idea and the system.In this paper,two aspects of defects of environmental governance in the conflict were studied.This paper is divided into five parts.The first part through the environmental conflict literature collection and research,found that most of the existing studies from the perspective of macro environment analysis of conflict,few scholars from the micro perspective to analyze the environmental problems.The second part defines the meaning and characteristics of environmental conflict,puts forward the theoretical basis of this study.The third part describes the fuzzy concept,the existence of environmental governance in the conflict,because the government plays multiple roles and environmental auditing subject and the content of cognitive dislocation in the environmental events,the local government's perception of the role of fuzzy logic exist difficulties to set emission standards;the environmental standard setting of thinking is not clear;the cognition and the orientation of the enterprise and the government of the sewage charges vary,sewage charges trading system's intention and the actual existence of contrast.The fourth part discusses the system defects of environmental governance in the conflict.The study shows that since the civil short tenure,collusion and environmental evaluation design defects,resulting in the system selection principle of deviation;the total amount of sewage has been approved due to economic development disturbance,the total amount of sewage has been broken,the initial allocation is not reasonable,the emission trading system it is difficult to form a unified national framework;public participation in environmental governance mechanism is not perfect,the public participation in environmental legislation,law enforcement andlitigation of the foundation is not solid,the scope of participation in environmental governance is too narrow;the environmental information disclosure of environmental information disclosure mechanism is not perfect,imperfect laws and regulations,the security policy of the government Lack of information disclosure is not accurate,not timely,the number of information disclosure of small enterprises,the content of a single,messy pattern,the lack of public participation in public opinion.In the fifth part,the author puts forward some measures to regulate government behavior,to change the current situation of fuzzy concept,to cooperate with each other and to improve the process of environmental legalization.
