As the rapid development of the global economy has brought tremendous pressure on the environment,leading to increasingly serious environmental pollution problems,more and more countries have realized the seriousness of the problem.Therefore,countries around the world and relevant international organizations are constantly exploring and researching environmental pollution issues.Among them,theinitial allocation of emission rights combined with government intervention and market mechanisms has achieved good results in the use of some countries and regions,and thus it has become an important method to control environmental pollution.The initial allocation of emission rights as the basis for emissions trading,occupies a very important position in emissions trading.As a result,China has actively explored theinitial allocation of emission rights.Although it has obtained a lot of successful experiences,it also finds that there is no legal system for the initial allocation of emission rights at the national level,and the imperfections of the subject for the allocation of legal relations,the simplification of theallocation model,and the imperfections of regulatory mechanisms and technical support.If China wants to make a breakthrough in the initial allocation of emission rights,then these issues must be resolved.Therefore,this paper focuses on the mature experience of leaning from initial allocation of emission rights of foreign,then combined with a series of problems in the practice process of our country and puts forward targeted the proposal.The proposal for improvement is that China should clarify the principle of the initial allocation of emission rights,establish and improve a legal system for the initial allocation of emission rights,clearly define the subject of the allocation of legal relationships,and flexibly select allocation models and improve supervision and management mechanisms.
