Historic districts carry the memory of urban social change,also use a continuous,concatenated space to write the story of time.In recent years,the government which has become the only main protection,is playing the more and more important role in protecting the historic districts and its enthusiasm also unprecedented.Historical outlook and the quality of life of residents has been greatly improved.But in this"one-man show",the contradictions are also escalating,resulting in such as weak social participation,the financial gap,low utilization of resources and other issues.In this process,calling on the community to participate in the operation of the district has become a breakthrough to resolve the contradictions.And the market,as a means to achieve social forces to participate in the protection of the tool,will become the future development of new trends.However,it is difficult in practice.The market failure may occurr.The new institutional economics think that the market failure is the result of the unclear definition of property rights.In view of this,the article draws from the property right theory of the new institutional economics to analyze the root causes of the marketization in the process of protection and renewal from the perspective of property rights.And also draws lessons from the relevant successful practice,taking Pingjiang historical district as an example to analyze the plight,and from the three aspects including property rights system,property rights reorganization and property rights transfer to put forward the historical district protection and update the market-oriented path.First of all,summing up the current market-oriented plight of China's historic districts.Finding that the lack of the main building under the abandonment of historical buildings,non-cooperative game under the "prisoner's dilemma" and one side under the interests of the demands of conflict are the main fetters.However,property rights as the starting point and end of the market behavior,is the breakthrough of the street market operation from the "negative abandonment" to"orderly flow",from "decentralized constraints" to "win-win cooperation",from "one side lead" to "multi-collaboration".Secondly,taking the Pingjiang Historic District of Suzhou as an example,analyzing the current dilemma of protection through the status of property rights.Finding that the dilemma including the lack of spontaneous power and funds and the low rate of utilization.The root of this lies in the "fuzzy","broken" and "single" of the property rights.Finally,from the three aspects including property rights system,property rights reorganization and property rights transfer,put forword the market-oriented path.On the one hand,as a framework of human behavior,the property rights systemis a powerful tool to protect the orderly operation of the market.On the other hand,the effective combination of property rights is the prerequisite for the best use of building value.By clarifying the boundaries of the property rights can enhance the protection of the renewal of the autonomous power;consolidating the ownership of the property can reduce the transaction costs of the protection update;and configuring the multiple rights can improve the efficiency of the protection update.On the basis of property right system and property right reorganization,the building cab be divided into vacant old house,residential ancient houses and monetized buildings.Respectively,put forward "trust" management,"adoption" protection and "diversified" shares of property rights transfer,the low utilization of resources and other issues.So as to protect the work of the historic districts escort.
