Establishment Of The Intellectual Property Protection System To Cultural-creative Industries In China

Under the global background of knowledge economy,cultural-creative industry is thriving and has become a new focus of each country ' s economic development.Compared with the development of cultural-creative industry in some developed countries,Chinese budding cultural-creative industry still has some problems.The development of cultural-creative industry is closely related to intellectual property protection.It is quite significant to create an integrative intellectual property protection system which is suitable for our country.First,by analyzing the latest data of our country ' s development of cultural creative industry and the comparative study of each country's development mode of creative industry,the researcher summarizes the current situation,the existing main problems as well as the trend of the development of cultural-creative industry.Second,the researcher explores the correlated mechanism between creative industry and intellectual property,including the incentive effect,inhibition and inverted "U" type relationship.Third,based on a clear understanding of the relationship between cultural-creative industry and intellectual property,the researcher aims to generalize the current situation of intellectual property protection of cultural-creative industry in China and analyze the current problems restricting our country's intellectual property protection in the field of cultural creative industry.Finally,according to the national conditions of our country,the development of cultural-creative industries,the current protecting system of intellectual property,as well as other country's experience,based on the correlation of creative industries and intellectual property,the researcher puts forward a blueprint of the developing of intellectual property protection system in the field of cultural-creative industries from a macroscopic view.Besides,the researcher based on time nodes of our country's current industrial development policy makes a three-step plan and proposes concrete suggestions for establishing the system from the perspective of the development of legislation,judiciary and the enforcement of law.
