Research On Intellectual Property Protection Of Chinese Cultural And Creative Industries

With the deep development of knowledge economy,cultural creativity has become the key element of national competitiveness.Cultural and creative industries have also become a new bright spot in the development of the global economy and modern industry.All the countries in the cultural and creative industries to develop at the same time,pay attention to the intellectual property system to support and promote the cultural and creative industries,and build a complete system of intellectual property rights protection and take effective measures to provide a good legal environment for the ring policy of the development of cultural and creative industries.Overview of today's world,the cultural and creative industries in developed countries are all very successful national intellectual property protection.Although China's cultural and creative industry starts at the end of Qingping,it has gradually become a new driving force for the development of China's economic quality.Shaanxi,as the starting point of the Silk Road Economic Belt,has a long history and profound cultural resources,and its research institutes are gathering.As the Ninth National Central Cities and the hard and technological capital of China,the capital Xi'an has great advantages in developing cultural and creative industries.The author expounds the protection of intellectual property rights in cultural and creative industries from the following aspects:First of all,it describes the intellectual property protection of cultural and creative industries.This paper introduces the concept of cultural and creative industries and related industries;the characteristics of cultural and creative industries;analysis of intellectual property protection on the inevitability of cultural and creative industry from the "labor value theory" and the "tragedy of the commons" theory;relevance of intellectual property and the cultural and creative industry;cultural creative industry the significance of intellectual property protection.Then,taking Shaanxi as an example,it discusses the protection deficiencies from five aspects: the current intellectual property law system,the intellectual property trading platform,the Industrial Park intellectual property management,cultural and creative enterprises,and cultural and creative talents,and analyzes the reasons one by one.Then,through the comparative study method,the learning method,the United States,the Korean,the Japanese,the new six countries,the intellectual property protection experience,and then put forward for reference.Finally,puts forward somecountermeasures for these five aspects: Law,perfecting the legal system of intellectual property rights and codification of intellectual property code;trading platform,the establishment of public non-profit trading platform,to promote cultural and creative intellectual property dormancy "traded;Industrial Park,intellectual property management model to set up the third party dominant CMC;enterprises,establish cultural and creative enterprise intellectual property management system,alliance organization,incentive system;personnel training,establishment of cultural and creative industries" training education system and improve the intellectual property of general education.
