Enterprise labor rules is a “Legal” within the enterprise, it can make sure of the working conditions, and adjust the labor relations, and regulate the behavior of the parties. Labor relations has an important role in the enterprise management system. The characters of labor rules mainly include the unilateral specificity of the formulation and changing?the specificity of the purpose and function? the openness of the domestic and the seal of foreign. Enterprise labor regulation has the legal nature of “contract specification”? “law specification”? “collective agreement” and “two contents theory” in labor law. The law risks and pretending of enterprise law rules establishment are ascribed by the main body?content and procedures. The contents include staff recruitment?labor contracts?labor remuneration?working hours rest and vacation?social insurance and welfare. The procedures include preparation procedures, developing procedures, review and revision of procedures. The law risks and pretending of enterprise labor regulations application include effection and procedures. The law risks of effection include object effect, time effect and space effect. The law risks of prcedure include staff disciplinary fact evidence collection?punishment of on the basis of labor rules and regulations?and the arrivation of punishment notice.
