Research On The System Of Public Warning In China

In the process of modern society, with the rapid development of productive forces and the increasing accumulation of wealth, modernity is standing out from the classical society, and it forms a new social situation-- the risk society. With the arrival of the risk society, from the risks dominated by natural factors to the risks dominated by human factors, the risk events spread more extensively,and appear more frequently. People are facing more potential threats and risks. In recent years,unexpected public health incidents, geological disasters, food safety incidents, major product quality and environmental pollution incidents occur frequently, which have huge impact on people's production and life, and also make new requests to the government. In the risk regulation, the government should make sure that both technology innovation and system innovation are constantly realized, then the new administrative behavior mode is created, that is, public warning. Public warning is an exotic, in modern sense, it was originated in Germany, therefore, the study of the public warning system in Germany is relatively mature. With the development of the administrative law and the coming of the risk society, the public warning system, as a mechanism to deal with the risks is particularly important. Whether it is in Germany,the United States, Japan and China's Taiwan region, many law scholars have done a lot of researches on public warning system, special laws are also enacted to determine the system.While in mainland China, although some scholars have studied the public warning system and some government departments have attempted to determine it, the national unified system has not really established. Thus, delve deeper into the public warning system of these countries and regions has an important reference for the improvement of the public warning system of our country.This article is based on the construction of the system as the main line, and is divided into four parts. The first chapter is an overview of the public warning system,also discusses its concept, characteristics, origin and nature. The second chapter is about the legal point of our country which is related to the public warning behavior.The third chapter analyses problems and deficiencies exist in the public warningsystem in China, provides a logical starting point for the improvement of the system.China's public warning system not only lacks macro mechanism and unified legal provisions, but lacks a unified national information system,which can not provide the government and the people with an unlocked information channel and accurate information. The fourth chapter mainly explores how to improve the public warning system in our country from two aspects: constructing the macro mechanism and perfecting the legislation system.
