On The Environmental Right In The Construction Of Ecological Civilization

Entering the 21 st century, environmental and ecological issues have become more fundamental for the development of human society. In the 13th-five year plan approved in the fifth session of the 18 th Central Party committee, our party for the first time has concluded the building of ecological civilization into the process of building a well-rounded prosperous society in the next five years and has put forward the development of green economy,and has formed an overall layout of political, economic, cultural, social and ecological development,and has given the priority to the building of ecological civilization. And our party will continue to build a good environment where people coexist with Nature and economic development moves forward with the environmental protection so as to build a beautiful China. In this context, environmental right as a symbol of current society has drawn a great attention in the process of building ecological civilization. A deep research on the environmental right is of great significance to properly understand and handle the relation between human beings and Nature and for building an environmental-friendly society in the process of promoting the building of ecological civilization in China.This paper aims at conducting a deep research on the environmental right in the building of ecological civilization. First and foremost, the author expounds the basic theory of ecological civilization construction and relevant knowledge of environmental right; Second, the author analyses the intrinsic consistency between the environmental right and ecological civilization construction from diverse aspects including historical origin,value orientation and ultimate objectives and expounds the interplay between the environmental right and the ecological right. Then, the author gives an analysis to some problems existing in the ecological civilization in China. Due to these problems, the author thinks that it is imperative and necessary to improve the ecological right which will have a positive influence on the ecological civilization construction. However, there exist some problems in the development of ecological right in our country since current environmental theory and the institutional construction fall behind the demand of ecological civilization construction, and nor do they satisfy the sustainable development of human society and the demand for sustainable development. In order to better conduct the ecological construction, and promote the coexistence between human and Nature, the author offers suggestions for constructing the environmental right, which requires not only the improvement of the theory and basic concepts of environmental right, but also the building of systematic guarantee for environmental right. At last, the author suggests the construction of a new-type environmental right and thinks the future road of the environmental right is the one with sustainable development.
