Rule Of Law Culture Research In Civil Governance

The introduction of the theory of "governance" and the modernization of national governance,provides the civil governance legitimacy theory foundation and policy guidance."Civil governance" refers to way of a kind of social governance that the civil society as the main subject participation in public affairs management,is the important content of national governance.The modernization of national governance requires the government to accelerate the transformation of government functions,coupled with the market failure,inevitable demands of civil governance is the social transformation and development,but also play social role,a practical and effective means to achieve national and social cooperation and co governance.In the context of the rule of law in China,the rule of law is the only way for the modernization of national governance;therefore,the rule of law in civil governance is the inevitable trend of the development of the rule of law practice.The rule of law culture is the cultural foundation of the rule of law,which is not only embodied in the rule system of explicit,organization carrier and behavior,but also the implicit value principle and spiritual idea.As the foundation of the rule of law,on the one hand,there is the inherent logic of the coupling between the civil governance,on the other hand,it can provide the important legal function.In addition,the current civil governance facing the fundamental causes of the rule of law in many difficulties is the lack of rule of law culture,embodied in the value of the modern rule of law lack,rule of law system is not perfect,legal organization development imbalance and inadequate representation of legal act and the way of non rational and illegal.Therefore,the construction of the rule of law culture of civil governance is the inevitable requirement of the rule of law.Then we can proceed from the following aspects.First,to establish and perfect the legal system of private governance;second,inheritance and transformation of traditional legal culture;third,reconstruction of multivariate compatible by the value of law;fourth,integration of folk norms play the function of rule of law;fifth,cultivate civic awareness,promotion of civil society organizations in the formation and development.
