A Study On The System Of Civil Society Rational Rules And The Rule Of Law

The root of righteous to the rule of law is restricting power and protecting rights.If we study the rule of law by putting it in the historical development of civil society and the country,we would get a deeper and more basical grasp.Therefore,for the research of the rule of law development,the civil society theory is of significance.It is no doubt that law is a common civilization created by the mankind.However,the civilization originated in the western world.The rule of law took root in certain historical conditions in western society,so we say that the historical origin of the rule of law in the west is really profound.As to the practice of our country,it is a typical country of rule of virtue,and legal tradition is congenitally deficient.Therefore,in the process of rule of law Chinese,subsequent erogeneity determines that we shall not simply plagiarize the western ruling of law,either should we copy the settings under the legal framework.Rather,it should be established the deep,intrinsic local foundation of the modern rule of law.In a sense,it should go beyond the so-called modern and traditional or post-modern and traditional,and consider the differences between the East and the West.In this way,it is possible to take the rule of law into China's reality.China's legal system may enjoy a solid social basis.In this paper,taking basis on the theory of civil society,conducting a thorough research on interactive relationship between the country and the civil society,we seek the response and agreement between ruling of law and civil society rational rule.
