The Research Of China’s Online Shopping Consumer Rights And Interests Protection Law Issues

As a new mode of consumption,online shopping compared compared to the traditional way of shopping,expand the time and space range of shopping,for consumers to reduces the cost,reducing the transaction time,make the network shopping consumers to better enjoy fast and convenient shopping experience.However,when people enjoy the convenience of online shopping at the same time,the network of consumer protection of the rights and interests of consumers are facing some of the problems are gradually revealed.Although China’s "consumer protection law"(revised in 2013)in the legislation on the protection of consumer rights involved in online shopping has a great improvement,but still need to be improved in terms of the relevant.Based on the "consumer protection law"(revised in 2013)involved in the online shopping consumer protection aspects of the use of empirical analysis is divided into the right to know,right to choose,right to protection of personal information,such as the format of the contract in the process of the damage the interests of consumers,and even bargain rights,security,legal claims and etc.the performance in the process of infringement of rights and interests,and confirm the main responsibility to consumers,the burden of proof is difficult to dispute jurisdiction confirmation and litigation costs lead to higher to online shopping consumers accounted for three of the weak in the lawsuit,the online shopping consumer rights protection problems are discussed in this paper and analysis system,and points out the shortcomings of the current in the network consumer protection legislation in china.Then through the comparison and study foreign typical countries legislation on online shopping consumer rights and interests protection,combined with our country describes the foreign legislation reference,at the end of the paper,including the perfect "consumer protection law"(revised in 2013)relates to network shopping consumer protection provisions,strengthen the network shopping consumer safety authority,and litigation is confronted with the problems to solve and improve external environment for network transaction proposals on Perfecting China’s online shopping consumer protection.
