Research Of Legal Issue Of Seafarer Social Insurance Of China

As a maritime power and the crew output power,China undertake the dual responsibility of the flag state and crew countries of their nationalities.Following the"Maritime Labor Convention,2006(MLC2006)"going into effect in china,it is very necessary to improve seafarers' social security system in accordance with the provisions of the Convention.As a core of the seafarers' social security,the seafarers' social insurance has become a top priority in the improvement of the system.Though we've made some achievements,but it still has some drawbacks,compare with other relevant international organizations and countries.In practice our country using land-based social security legislation to regulate and protect the crews,it lead to many legal issues.In view of the special nature of maritime labor,it is absolutely necessary to make special provision on social insurance of seaman in accordance with the minimum requirements of the MLC2006.Thus promote the growing the numbers of crew,promote the healthy development of shipping industry in further.In this thesis was summarized the concept of crew at the situation part we discussed from the legislative situation and practice of social insurance status quo crew two parts.Proposed corresponding countermeasures to give our crew more adequate social security and promote the development of China's shipping industry.This thesis includes introduction,main body and conclusion there parts,the main body part was divided into five chapters.The first chapter defines the concept of the crew,summarized the work environment and condition of the crew,and on this basis,we described the social insurance problem of crew.In chapter two described the International Convention on the crew and social security provisions of the ILO adopted the contents of seafarers' social insurance on the MLC2006.In chapter three the Current Social Insurance of crew were analyzed,and discusses the issues from two aspects of current legislation and practice.In chapter four analyzed the legal issues of social security of crew right now in our country.The last chapter describes Combined with the low of MLC2006 and advanced experience of other countries to find out the solutions form the development of special laws,the establishment of specialized regulatory agencies and the trade unions play seafarers and other aspects of the role of the social insurance law.
