Study Of Administrative Function Disposition In Marine Management Of China

The State Council put forward to reorganizing the State Oceanic Administration,and establishing the National Oceanographic Council and China Coast Guard in the new reform in 2013.Also,the administrative function between the State Oceanic Administration and the Ministry of Environmental Protection,the State Oceanic Administration and the General Administration of Customs,the State Oceanic Administration and the Ministry of Transport,was redivided.This shows that the marine management system in China is gradually concentrated.However,the reformation has not implemented successfully so far.For example,the personnel allocation of the National Oceanographic Council and China Coast Guard is badly in need now.Furthermore,the marine management system is still imperfect even after the reform in 2013,with a view to target orientation and function division.Therefore,it is necessary to continuing improve the marine management system of China.Just like it is central to transforming the administrative function in the reform of administrative system,marine administrative function is also the core of marine management system.Therefore,it is important to complete administrative function in marine management.Usually,administrative function is composed of target orientation,function division and organization establishment.This paper can be divided into three parts.Part one mainly introduces the present condition and the problems of marine administrative function disposition in marine management,and analyzes the reasons.Part two is about the experiences of three countries,South Korea,the United States and the United Kingdom.Part three offers proposals of how to allocate administrative function in marine management from the reality of the country.To complete the allocation of administrative function in marine management,there are three things we need to do.First,it is important to realize that marine management is the unity of the sovereign,resources and environment.Also,it is necessary to attach great importance to integrated marine management and ocean ecosystem management.Second,marine policy formulation should separate from marine law enforcement,on the basis of separating policy making from policy implementation.Also,it could be divided into marine administration policy and marine occupation management policy,when formulating marine policy.Third,the organization establishment in marine management should be further improved,such as the State Oceanic Administration,the National Oceanographic Council and China Coast Guard.In a word,to reform marine management system of China,it is necessary to improve the marine administrative function under the existing framework,instead of reestablishing an independent marine management department.
