"Special Car" Economy,the Present Law Situation Of Sharing Economy In China

With the support of the high speed development of internet,sharing economy,which characterized by increasing the utilization rate of idle resources,decreasing transaction costs and founding the interpersonal relationship whose core is trust between strangers,is gradually appearing in public.The development of sharing economy urgently requires relevant law and regulations to normalize the arising problems from within.Firstly,this essay states that sharing economy is confronted with the questioning to its legality.The public shares a positive view on sharing economy,while the government banned it at one time for its lack of the support of current laws and regulations.However,as sharing economy is getting foothold in various sectors,the government is gradually changing its attitude from utterly denial to conditional admit toward sharing economy.Sharing economy,as an innovative mode of economy,definitely possess differences from traditional mode of economy.Such differences are mainly reflected by the public’s attitude towards resources:utilize or occupy.The ambiguity of legal responsibility and the lack of relevant supervision regulations make sharing economy get into a dilemma,which,on the contrary,indicates the urgency to publish laws and regulations to normalize sharing economy.Secondly,through the research on the practice achievement of some main developed countries,applying laws to govern sharing economy is no doubt the best way.On the initial stage,different countries have different attitudes towards sharing economy.Some countries assist the development of domestic sharing economy actively,while some countries believe sharing economy is against the current domestic laws,and also some countries hold neutral attitude.Nevertheless,as sharing economy are producing enormous benefit for the world’s economic development,most countries are gradually realizing that governing sharing economy by reasonable laws and regulations can greatly strengthen its inherent weakness.Thus,those countries who held negative or neutral attitude gradually changed their mind.Thirdly,through the research on the development process of sharing economy,represented by "special car" economy,in China,it is found that although we have few laws and regulations to govern it,we can inevitable avoid problems like low criteria of entering and exiting the market,lack of guarantee for customers’ dealing safety and privacy,and suspect of unfair completion.All those problems are devoted to the lack of strict regulations for market entering,the ambiguity of market orientation for "special car" economy,a new mode of sharing economy,and the lack of safety rules to supervise the whole market of"special car".Finally,in order to regularize the "special car" market and sharing economy,this essay proposes to complete the current laws and regulations.Sharing economy should be promoted to the status of law and be made into concrete articles of law,but not only be mentioned in various conferences or documents.We should develop the initiatives of sharing economy and adjust it to be in harmony with the current laws and regulations.We should reconstruct supervision procedure,build efficient supervision authorities and reasonable supervision scheme,as such,we can supervise sharing economy from both inside and outside.We should emphasize the rationality of government intervention,highlight guiding intervention and give sharing economy more freedom.We should set up limits for the threshold of market entering,and those who passed the formal examination and substantive examination separately by the government platform and supervision authorities can pursue relevant business.We should differentiate sharing economy and traditional economy,develop specified market,avoid vicious competition.We should guide sharing economy towards a brilliant future of development when laws,regulations and administrative rules are made.
