Study On The Problem Of The Government Purchasing Public Legal Service

It is the new goal put forward by the Fourth Plenary Session of the 18 th CPC Central Committee to construct the public legal service system covering urban and rural areas,which indicates that the construction of public legal service system has entered a new stage.The government’s purchase of public legal services is an important part of China’s public legal service system.It plays an important role in the development of the socialist market economy,the prosperity of the legal service market,the promotion of economic and social transformation and upgrading,the settlement of social conflicts and disputes,and the improvement of people’s livelihood,but also the implementation of the party’s eighteen report on the more emphasis on the rule of law in the national governance and social management in the important role of a concrete manifestation.At present,Our country’s public legal service system is still in its infancy,the various systems and measures of the government to purchase public legal services are still imperfect.The purchase of legal services in the field of public goods is not only the bold exploration of the government to purchase public goods to the social forces,but also the inevitable trend of the rule of law in our country.To smoothly promote the governmental purchasing of public legal services,our government should base on the national conditions,the advanced social management experience and model drawn from foreignal countries,and the timely change of traditional thinking model and management methods.The construction of public legal service system in our country is a huge and complicated project.This paper studies the problems of our government’s purchase of public legal service from the angle of purchase.First of all,this paper reviewed the situation of the basic theory of government purchase of public legal services,which provides theoretical references for the government to purchase legal services.Then,based on the construction of local public legal services,this paper analysis the existing problems in the process of government purchase from the terms of laws and regulations,the purchase scope,the purchase procedure,Finally,according to the problems raised in this paper,in order to improve the government purchase mechanism continuously,we must strengthen the legal construction,expand the scope of purchase,purchase specification procedures,expand personnel scale,increase investment,improve the supervision mechanism to ensure the public legal service’s steady and enduring development.
