The Empirical Analysis Of The Power List Of Public Security Administrative Punishment In Shanxi Province

Public security organs as an important national administrative organs,the administrative punishment is a typical behavior of the public security law enforcement.Power is not only large but also wide,and directly related to the rights and obligations of the administrative counterpart.In practice,collect fines,bribery,abuse of power phenomenon is very common.One of the reasons is that the power is not clear,the power is set at random.Therefore,it is urgent to regulate the exercise of public security administrative punishment right,so that the administrative relative person can protect their own legitimate rights and interests in the legal and impartial law enforcement environment.At present,the country set off a wave of power list system reform,the purpose is to further restrict and regulate the exercise of administrative power.It is conducive to the transformation of government functions and the construction of the rule of law government.Power list system is a major political task and political responsibility for the central and local government departments at all levels.The public security power list is an effective response to the above problems.But at present,the research of this system is still in the primary stage,and there is less research on the public security administrative punishment power list.Through the theoretical and empirical analysis,this paper makes a comprehensive research and Analysis on the power list of administrative punishment in Shanxi Public Security Bureau,and puts forward the countermeasures and suggestions,which has strong theoretical and practical significance.The paper consists of four parts,about sixteen thousand words.Part one analyzes the basic value of the power list of public security administrative punishment.First analyzes the connotation and characteristics of the power list and the power list of the public security administrative punishment,and from the legislative and law enforcement level to discuss the necessity and significance of the power list.Part two focuses on the practice,results and characteristics of administrative punishment power list of Shanxi Public Security Bureau.Part three analysis the problems exist in the second part,Such as the standard is not unified,publicity efforts are not enough,the lack of third party opinions,etc.As well as the causes of these problems,Including the heavy task,time tight,the lack of experience,the government led,etc.Part four,according to the second and the three part puts forward the targeted suggestions.Including four aspects:to clarify the boundaries of power,establish uniform standards,strengthen supervision and dynamic adjustment,and improve the quality of public security personnel.Hope that through this study can be beneficial to the improvement of the power list system,regulate the operation of public security administrative punishment right,and protect the legitimate rights and interests of the administrative relative person.
