Research On The Practice Of Administrative Constraint In Maritime Affairs From The Perspective Of Enforcement Of Public Policy

Despite the fact that "Enforcement of public policy"and "Administrative constraint in maritime affairs" belongs to two different subjects, however, there are something in common that they both focus on public administration. While laws and regulations is one of the most important carriers of public policies, generally, the enforcement of laws and regulations reflects the execution of public policies.Recently, administration according to law has already become the tendency of government reform. Chinese government emphasis in how to reduce administrative examination and approval item, as well as how to standardize administrative procedures, In this background, The "Administrative Enforcement Law" act into force in Jan.1st. 2012, The "Administrative Enforcement Law" aims to deal with disputes in the field of administrative law, nevertheless, due to the complexity of maritime administrative enforcement and massive of referred laws, affairs of Chinese administrative enforcement still in the exploratory stage of Pathfinder.Owing to the high value of ships, the operation of shipping is vulnerably affected by maritime administrative enforcement, which shows the specificity of administrative enforcement which maritime authorities should pay more attention. The authors carry out the work on the front line and experience the difficulties of the maritime law enforcement.Therefore, basing on the maritime front-line law enforcement case as well as referring to the foreign experience in law enforcement and the research of relationship between the enforcement of public policy and maritime administrative enforcement, this paper tent to abstract the advantage of the theory of public policy which could take effect in the work of administrative enforcement., and to summarize and extract the method of improving the work of maritime administrative enforcement.
