Research On The Scope Of Accountability For Major Administrative Decisions

The administrative accountability system originated from the responsibility of the major safety accidents,which was paid much attention to by theory and practice after the SARS event in 2003.But compared with the implementation of the accountability and the accountability for results,the accountability of the decision-making process has not been given due attention.Thus the goal and the construction of the government under the rule of law clearly draw further apart.Decision-making power,especially the major administrative decision-making power as the most important administrative power should be exercised under the system of regulation of administrative law.It is because of the concept of administrative decision-making theory,extension and nature has not formed a unified understanding of the concept,and legal status of "administrative decision "and" major administrative decision-making "has always been in the crevice between the traditional concept of administrative law and the modern administrative law,leading to major administrative decision-making responsibility in local legislation in the scope of decision-making responsibility is not clear.The scope of accountability of the major administrative decision-making accountability,or situation of accountability,or liability for duty,whose essence is to clear decision makers in their millions of perplexing major administrative decision-making behavior,which is subject to the system of investigating the case and assume the corresponding responsibility.In order to build a major administrative decision-making accountability system which is facing many difficulties and problems,we must first solve the problem of clearing the scope of responsibility,which is the legal system of the threshold,directly determining the geometry system capacity of the system,the major administrative decision-making responsibility system validity and decision-making efficiency.In view of this,coupled with the special research on this part of the little research on the scope of accountability problem whether it has great significance to the theory and practice.I combed through PKULAW.CN related to local government regulations and normative documents,then found that the legislative level in major administrative decision as the object of the procedural rules,the accountability system(or responsibility)for the overall system design is scanty provisions,not to mention the scope of accountability of the scientific and reasonable definition.This is the case,the text of the specification is also the major administrative decision-making accountability and responsibility range.Besides,I collected the major administrative decision-making responsibility to ask related event processing,then summarized the problems and experience for the construction of programs,expecting to provide the feasible path and design for the scope of accountability.The paper mainly discusses from four aspects of the major administrative decisions of the accountability problem:the first part mainly explains the basic theory of the major administrative decision-making accountability system about the scope of accountability,including the responsibility of administrative decision-making,the major administrative decision-making and the major administrative decision-making responsibility system,those three basic concept and connotation are analyzed separately.And then I put forward the scope of accountability the concept of discrimination,the position of its function,the trace of its construction and the theoretical basis for the design.The second part mainly discusses the major administrative decision-making responsibility scope.The status gained from combing local government regulations and normative documents such as standard text and major accountability events,helped to get a glimpse of the scope of accountability problems,and further analysis of the reasons for these the effects and possible,providing direction and motivation for the construction of the scope of accountability.The third part mainly discusses construction of the scope of accountability of the major administrative decision-making accountability system,which but also the-significance of this article lies.Combining with the research results presented above three parts to establish the scope of accountability I put forward the principles and considerations,the legislative mode,and finally I created to design a major administrative decision of the accountability system,in order to contribute to building a major administrative decision-making accountability system in China.
