Research On The Legal Accountability System Of Major Government Decisions

The major decision matters of the government are characterized by comprehensive,long-term and global characteristics.,It is about the national economy and the people's livelihood.From the "Xi'an subway cable event" to deal with the law of 122 responsible persons in the relevant local functional departments to "the illegal construction of Lanzhou Hong Kong Federation invaded the flood control river events" as a typical government law violation case.These cases not only damage the authority and credibility of the government,but more importantly,it infringes on the vital interests of the common people and seriously threatens our personal safety.This kind of situation shows that it is imperative to improve the accountability system of the government's major decisions.Government's major decision-making responsibilities can be divided into political responsibility,moral responsibility and legal responsibility.In practice,there is a lack of special laws to regulate the legal responsibility of major decisions of the government.Therefore,this article will sort out the existing laws and regulations,and try to further improve our government's major legal accountability system.This article is based on the clue of whom has to take procedure and way responsibility to undertake what kind of consequences.On the basis of solving this series of problems,this paper makes a theoretical discussion on the system of.the legal accountability system of major government decisions.First of all,to explain the basic theory of the system,to clarify the connotation and extension of the concepts of the major government decisions,the accountability of major government decisions,the legal accountability system of major government decisions and so on.To identify the classification of the accountability of major government decisions The purpose of this paper is to outline the basic theoretical framework of the legal accountability system of the government's major decision-making,so that we can have a comprehensive and deep understanding of the system of the government's major responsibility investigation.Secondly,we analyze the current situation of the accountability system of our government's major decisions,and analyze the legislation and operation status of the accountability,in order to improve the major government decision-making accountability system and make the right choice.Thirdly,this paper analyzes the problems in the system of the legal accountability of major government decisions.Through the analysis of the ambiguity of the subject of accountability,the ambiguity of the scope of the matter of accountability,the dislocation of the object of accountability,the ambiguity of the starting standard of accountability,and the imperfection of the accountability procedure,the author tries to find out the countermeasures.Thus,the theoretical problems existing in the process of investigating the legal accountability of the major government decisions are perfected.Finally,on the basis of the above exposition,we perfect the legal investigation system of our major government decisions,on the basis of drawing lessons from the foreign advanced experience,from the basic principles of the accountability system,the main path of pursuing accountability is analyzed.Three levels of improving the system of main responsibility investigation are put forward,so as to construct a sound and complete system of legal accountability for major government decisions.Through the exploration of this article,we hope that we can put forward reasonable suggestions to the perfection of the system of investigating legal responsibility for major decisions of the government,so as to solve the predicament of the current system in theory and practice as soon as possible.Therefore,the basic principle of "who makes the decision and who is responsible" is really put into practice,which has a positive role and significance to promote democratic politics and social progress,or to build a responsible government and a government ruled by law.
