The Perfection Of Chinese Legal System For Water Transport Of Goods

From ancient times,water transport has been the main means of transportation between trade parties by virtue of large capacity and low freight,and the water transport activity itself also bring huge benefits for a country's national economy.What's more,water system in our country has a unique advantage in the field of carriage of goods by water.It is no exaggeration to say that water transportation activities is becoming the important link of the national economy.However,in contrast,there are many imperfections in our country legal system construction in the field of carriage of goods by water,and the track system in the application of law is a big problem,which cause many difficulties in the practice.On May 30,2016,the Ministry of Transport promulgated a decision to repeal 20 pieces of transportation rules and regulations,including the rule which adjust in coastal and inland waterway transport of goods,which also made an impact to the current legal system in the carriage of goods by water.This paper takes it for opportunity,reviewing the water transport law system in our country,and probe into the perfection of legal system.in the field of water transport in our country.This paper is divided into four chapters.The first chapter mainly introduces the present situation of Chinese legal system for water transport of goods.The first chapter is divided into two sections,respectively discusses the background of the "double track",development process and problems as well as the abolishment of the rule which adjust in coastal and inland waterway transport of goods.The second chapter analyses the possible legal system for water transport of goods for one country at a macro level.Through the study of current legal system of other countries and regions,extract commonality,on this basis,sum up three models and apply into our country.The third chapter and fourth chapter respectively focus on the legal system of our county's coastal and inland water transport,and put forward legislative suggestions on how to perfect the legal system.
