Research On The Legalization Of Rural Governance In The New Urbanization

The research on the legalization of rural governance under the new urbanization is the innovation and breakthrough of the traditional rural social governance.It also solves many real conflicts that are generated during the current urbanization and social transformation.Through reading domestic and foreign researches,studying the order of historical development in urbanization and social governance,and researching the interrelationship between urbanization and social governance,Chinese new urbanization has promoted the transformation of social governance concepts.The continuous social governance innovation has also promoted the development of urbanization.Since the establishment of People's Republic of China,urbanization can be divided into the initial stage,the accelerating stage and the rapid developing stage.Social governance can be broadly divided into two types,traditional and modern.Each of these types can be divided into three stages,in accordance with time,that have specific characteristics.With further deepening concept in governing country by law,present rural social governance combines the modern factors in "marketization" and "legalization ".Therefore,in the process of promoting the new urbanization,it is urgent to use the force of law to transform the rural social governance from the rules system and so on.The key point of social transformation is protecting famers' basic right.By introducing the law concept and background in rural social governance,mainly the equality of Marx's subjectivity,the subjectivity of peasants and the legitimacy of power,it is a process seeking the theoretical basis for the legalization of rural governance.For the peasants' right,the subjectivity is the carrier to exercise the right,the equality is the value that the right chases,and legitimacy is the criteria that the right depends.Nowadays,due to the defects of governance mode,lack of reserve of talents,poor coordination of organization and other issues,the problems of rural social governance in China are apparent and hard to solve.Thus,it should be combined with the current problems of rural social governance in China and then be solved.By using the Marxism in scenario of China,improving the legislative process,simplifying the proceedings,reducing the litigation costs,improving the docking mechanism and other measures,the Marxist rule of law can be quickly and effectively utilized to the process of rural social governance,which makes realization of farmers' rights get fully guaranteed.Finally an idealized and harmonious rural social state where the government acts according to the law,the people comply with the rules will be achieved.
