Urbanization In Contemporary China From The Perspective Of Rule Of Law—Problems And Reflections

Urbanization sustainable development in contemporary China,especially after the reform and opening-up policy,domestic and international environment of relative peace for the speeding up of urbanization provides the essential condition.Both opportunities and challenges,however,the development and problems,with the development of city,urbanization of the growing problem of,has aroused the concern of the society each domain and there is no exception.This article mainly discusses the rule of law problems in the process of urbanization,the problem of study and research to these questions for reflection at the same time,the relationship between the urbanization and the theory of rule by law and on this basis,the new conception of the rule of law in the process of urbanization construction.This paper is divided into four parts:the first part,the introduction part.A brief generalization of this part of the thesis topic selection,including the definition of\"contemporary\",for some basic problems of urbanization such as connotation definition and character analysis,and then put forward problems and analyze the historical background and the significance of the research topic.The second part,the paper's first chapter is about the problem of rule of law in contemporary China's urbanization process.This chapter first of all,from the historical dimension of contemporary China's urbanization process and the rule of law respectively are discussed in this paper,it is concluded that there is a certain correlation between them.Then the research field of law,department of law many more specific research on the problems of urbanization,the legal theory in recent years,there are more research on the city law problems but still insufficient comparative study and the lag of legal theory research.The third part is about the relationship between urbanization and the rule of law jurisprudence analysis.First default theory of urbanization and the rule of law has relative independence,have their own characteristics and law of development,the correlation of both the link is that China's unique political and economic relations,urbanization and the rule of law is influence each other,accompanying,role to the improvement of the government by law of urbanization,urban development will promote the progress of the rule of law,urban problems and hinders the progress of the rule of law,at the same time it puts forward higher requirements on the rule of law governance.Under the rule of law is guaranteed role on urbanization process,the rule of law,meanwhile,has become\"brake\" of rapid urbanization.The fourth part is the new ideas of the construction of the rule of law in the process of urbanization in our country.Through the legal analysis of the relationship of urbanization and the rule of law,we should be in a new way of thinking about urbanization in urban development,in the process of the construction of the rule of law and the rule of law in our country modernization,urbanization and the rule of law should promote,coordinate mutually embedded.So this chapter constructs the new train of thought on the development of the rule of law,the top of the first to have a rational design,with the urbanization shape of the rule of law,to guide urban development rule by law,to realize the benign mutual embedded of urbanization and the rule of law;Second,our country is a large country,and the present situation of unbalanced development in various regions determines the design on the top floor will be under the guidance of our country can be divided into three regions for the diversity of the local practice,our country the eastern region should pay attention to the rule of law in the role of city governance;Rapid urbanization in central China,should pay attention to the cultivation of the spirit of rule of law;In the western region economy is relatively backward,and the rule of law is lack of soil,should pay attention to the economic development to stimulate the advancement of urbanization,the development of commodity economy to build the rule of law the foundation of growth.In this paper on the grasp of there are still many deficiencies,and theoretical analysis but can let us starting from the problems,to find the intrinsic relationships between urbanization and the rule of law,have certain inspiration function.
